There is a letter to all of the candidates ~ that are interested in taking the examination and a there's specifics of the test, and the second 9 page is the actual posting that's posted in the io department that the promotional exam would be. 11 Q. Is this the normal procedure that is usually iz employed when a promotional exam is going to take 13 place and go forward? i4 A. Correct. 15 Q. And is it normal for Mr. Ubaldi to send this to i6 you via a-mail or some other means for you to i~ produce? is A. Yes. i9 Q. So there is nothing unusual about him sending 20 this to you at this point, correct? z i A. Correct. z2 Q. Now at some point did Mr. Ubaldi call you a third z3 time that morning? 24 A. He wanted to know if 1 received his a-mail in ~ regards to the posting. I indicated yes, I did, a but I am not allowed to post the posting. s Q. Okay. 1o A. Because the matter was being reviewed. ii Q. All right. So the reason you informed Mr. Ubaldi 12 that you could not post it at that time was 13 because the matter was being reviewed by the law is department, correct? is A. Correct. is Q. Okay. And you informed Mr. Ubaldi of that? i~ A. Yes, I did. 1a Q. What was his response to that? i9 A. He didn't say anything at first and I said, "I'm zo in the middle." And then he then said that he zi understood. 22 Q. Okay. Then did he ask any questions about the 23 procedure on how to post this notice? za A. Yes, he did. 25 Q. Okay. Was it your understanding as a result of Page 31 i this conversation that he was going to post that z notice, if not that day, shortly thereafter? 3 A. Yes. 4 Q. How long did this telephone call take place? s A. Probably about five minutes. s Q. Okay. After that call, what happened then? ~ A. I called the HR director, she was out of the a office, to inform her. Because usually I always 9 go through the HR director or law if I have a, io you know, just in regards to anything. ii Q. Sure. And that's your normal practice? iz A. That's my normal practice. 13 Q. Okay. i4 A. I left her a message, and then I called the law is director and he informed me just to make a note i6 of the date and time. i~ Q. All right.
