,~-_~,. <br />Council Minutes of 01-04-2011 <br />David Neville re-appointed to the Landmarks Commission for the term January 1, 2011 <br />through December 31, 2012. <br />AUDIENCE PARTICIPATION <br />Dennis Lambert, 25057 Carey Lane said in the City's Charter, it is a requirement that a <br />referendum petition has to be signed by ten percent of the total registered voters in the <br />City of North Olmsted. That is illegal. Westlake just changed theirs the last time. Right <br />now, the State allows only the number of voters that actually cast votes in the last general <br />election to be the number that the ten percent is based on. He requested that Councilman <br />Mahoney look into this and to write a Charter change for the ballot. Gareau said he <br />would be happy to look into this, and said if Lambert thought it was an issue he should <br />have brought it to the Charter Review Commission. Lambert said since the Charter <br />change in 2003, it is a recommending Commission. Council can turn down <br />recommendations. Limpert said the Charter Review Commission's job is not to wield <br />power, but to be a recommending body. He appreciates the recommendations they have <br />submitted to Council. Barker said eleven out of twelve Charter recommendations went to <br />the ballot. That speaks for itself. <br />LEGISLATION <br />Ordinance 2010-158 introduced by Mayor Kennedy on behalf of himself and <br />Councilwoman Jones was given its third reading. An Ordinance amending the Traffic <br />Control File of the City of North Olmsted to provide for the placement of "Left Turn <br />Yield on Green" sign at the traffic light for Porter Road southbound at the intersection of <br />Lorain Road in the City of North Olmsted. Councilman Mahoney moved for adoption. <br />The motion was seconded by Councilwoman Williamson and passed unanimously. <br />Ordinance 2010-158 adopted. <br />Ordinance 2011-1 was introduced and placed on first reading by Mayor Kennedy. An <br />Ordinance creating new Section 111.10 of the Administrative Code of the City of North <br />Olmsted entitled, "Public Utility Contracts" in order to establish a contracting procedure <br />to be used in securing contracts for the providing of public utility services to municipal <br />buildings and fixtures, as amended. <br />Ordinance 2011-2 was introduced and placed on first reading by Mayor Kennedy on <br />behalf of himself, the Council President and the entire city Council. An Ordinance <br />dispensing with the RFP process otherwise required by Sections 111.03 et seq. of the <br />Administrative Code and authorizing the Mayor, subject to approval of the Board of <br />Control, if necessary, to enter into five-year agreement with the Walter H. Drane <br />Company for the purpose of providing ordinance codification services to the City of <br />North Olmsted, and declaring an emergency. <br />3 <br />
