Council Minutes of 08-21-12 <br />. ~ new parallel relief line on Chapel Hill Drive as well as increased capacity for the <br />Dover Pump Station. One million represents the costs of sequencing and staging <br />to maintain WWTP operations while meeting strict EPA deadlines. The last $2.5 <br />million is for association costs of additional labor of staging and sequencing. <br />Despite these costs, the rate structure will not need to be adjusted as the interest <br />rate is more favorable than first estimated. Another committee meeting will be <br />held next week for further discussion. <br />AUDIENCE PARTICIPATION <br />Debbie Comery, Rocky River Clerk of Court said that it states in the Council meeting <br />minutes that the city plans on using fine money to cover costs for operating the Mayor's <br />Court and that the proposal is a business decision. She said in 2009 based on 8,685 cases <br />North Olmsted had with Rocky River Court, $364,474.43 was given to North Olmsted. <br />In 2010, North Olmsted received $428,175.77 from the Rocky River Court. In 2011 it <br />was $446,348.43. Comery said it seems Cuyahoga Falls Mayors Court is being used as a <br />"template" by North Olmsted. Fines collected in Cuyahoga Falls Mayors Court in 2011 <br />were in the amount of $156,621. She asked if this was used to operate the Mayor's Court <br />and Cuyahoga Falls said yes. She asked what the expenses for 2011 were, and the <br />amount was $152,870 which leaves a profit of $3,780.83. Mayor Kennedy said he <br />received a copy of this information from Comery and he sent it to Cuyahoga Falls and <br />they laughed. The $156,000 is the budget they put forward because their expenses are <br />$152,000. The gross amount Cuyahoga Falls gets from their court is $750,000 as he sent <br />Comery the article pointing that out. The fact that Comery does not understand this is <br />almost laughable. Comery said this is the response from the Cuyahoga Falls Treasurer. <br />Mayor Kennedy said the information Comery is giving Council is completely wrong. <br />Councilman Mahoney made a motion to extend Comery's speaking time and the motion <br />was seconded by Councilman Barker and passed unanimously. Further discussion <br />ensued about the Cuyahoga Falls' budget numbers and fines. Councilman Kearney asked <br />Comery how much Rocky River Court keeps out of the money they give back to North <br />Olmsted and she said they don't keep a dime. It represents every penny of fine money. <br />Comery said they keep the court costs to run the court. Mayor Kennedy said North <br />Olmsted uses Cuyahoga Falls as a model because they have the same amount of tickets <br />and they are a court that started recently. Comery said in 2011, the amount of money that <br />was paid to the State out of the cases submitted by North Olmsted was $289,226. The <br />money paid to Cuyahoga County was $35,194. She said these are mandated fees and she <br />wants North Olmsted to be aware of that. <br />Brian Hagan, 3926 Mark Avenue, Rocky River urged Council to ask for Cuyahoga Falls <br />records instead of just looking at an article. He reviewed the numbers that Comery spoke <br />about. Councilman Mahoney asked if the Rocky River Court has received any awards or <br />distinctions. Hagan said the Clerk may have received accolades; he is not sure. Comery <br />said they do not have a separate audit from the City of Rocky River, so if any accolades <br />have been given, it would be given to the city. <br /> <br />5 <br /> <br />
