Council Minutes of 04-17-2012 regarding cutting grass on vacant and abandoned properties and $36,394 from r: Street Maintenance Materials and Supplies to Contractual Services. The Finance `~ Director has requested suspension of the rules on this Ordinance. Councilman Mahoney, Chairman of the Building, Zoning & Development Committee: The BZD Committee met Tuesday, April 17, 2012 at 7:15 p.m. Present were committee members Mahoney, Kearney and Barker; Council President Limpert; Council members Brossard, Orlowski, Schumann and Williamson; Planning/Development Director Wenger. • Discussed was CMS 12-02 Nissan of North Olmsted located at 28596 Lorain Road. This proposal consists of demolishing an existing building in order to expand the parking that is available for the dealership along with certain site improvements. This was approved by the Planning and Design Commission with five conditions and it also went before the Board of Zoning Appeals which granted four variances. The committee voted 3-0 to recommend approval of CMS 12-02 Nissan of North Olmsted. Councilman Mahoney made a motion to approve CMS 12-02 Nissan of North Olmsted located at 28596 Lorain Road subject to the conditions set forth by the Planning and Design Commission. The motion was seconded by Councilman Brossard and passed unanimously. CMS 12-02 Nissan of North Olmsted approved. AUDIENCE PARTICIPATION No audience comments. LEGISLATION Resolution 2012-20 introduced by Councilman Orlowski on behalf of himself and Councilman Barker was given its third reading. A Resolution in opposition to the State of Ohio pursuing control of municipal income tax collection and declaring an emergency, as amended. Councilman Orlowski moved for adoption. The motion was seconded by Councilman Barker and passed unanimously. Resolution 2012-20 adopted. Ordinance 2012-25 introduced by Mayor Kennedy was given its third reading. An Ordinance enacting new Chapter 944 of the Streets, Utilities and Public Services Code, entitled "Indigent Burial". Councilwoman Williamson moved for adoption. The motion was seconded by Councilman Mahoney and passed unanimously. Ordinance 2012-25 adopted. Resolution 2012-35 introduced by Mayor Kennedy was given its second reading.
