MINUTES OF THE MEETING OF THE COUNCIL OF Tf~ CITY OF NORTH OLMSTID NOVEMBER 16, 1993 Present: Council President Boehmer, Council Members Babas, Leonard, Lind, McKay, Musial, Nashar, Saringer Also Present: Mayor Ed Boyle, Law Director Michael Gareau, Clerk of Council Barbara Seman Council President Boehmer called the meeting to order at 8:02 p.m. in Council Chambers, 5200 Dover Center Road, North Olmsted, Ohio. Members of the audience Caere invited to join Council in reciting the Pledge of Allegiance to the Flag. The minutes of the meeting of November 3, 1993 were approved as written. Mr. Boehmer announced that Ordinance No. 93-139 would be passed under suspension of the rules. Mayor Boyle reported: 1) On behalf of the Town Club, Mrs. Crider has donated an American Flag to the city. 2) The employee suggestion program is now under way. A meeting was held with all Directors and Department Heads to explain the program and to discuss methods of reviewing and implementing suggested plans. Suggestions are already com3.ng in from employees in various departments. 3) Met with representatives of Squire, Sanders & Dempsey today to discuss a variety of topics; mainly, projecting borrowings and the senior housing complex. 4) The opening on the Planning Commission will be filled after the Wal-Mart issue is concluded. Candidates for the Planning Canmi.ssion will be presented to the members for individual and independent comments to the Administration. The Commission will not be asked to vote on the candidates. 5) The North Olmsted Municipal Bus Line was featured in a recent issue of Bus World, a national publication for bus managers.. The article discussed reverse privatization at the North Olmsted Municipal Bus Line. 6) The World Health Organization has recognized December 1, 1993 as "World Aids Day" in order to focus an encouraging governments, communities ar~ci individuals to talk about Aids in an effort to stop the spread of this disease. It is estimated that there are 14 million people infected with the HIV virus, and this virus has caused a resurgence of tuberculosis. 7) In compliance with the Charter, the Mayor has officially reappointed all current Directors to serve during the next term beginning January 1, 1993. Law Director Gareau reported: 1) The Mayor has acted properly in reappointing the Directors according to the City Charter. This provision of the Charter had previously been interpreted by the Supreme Court in Corrigan vs. Noble. 2) With regard to the Nova case, their attorney has stated that with the passage of Ordinance 93-134, they will present their check for tap-in fees to the city and will dismiss their lawsuit. Because the insurance company cooperated with the city and did not begin work on this lawsuit, there will be no cost to the city. 3) Once notification has been received from SERB as to the di~nissal of the fire- fighters request to reopen negotiations with regard to smoking, the declaratory judgment action filed by the city will be dismissed.
