MINUTES OF THE MEETING OF THE COUNCIL <br />OF Tf~ CITY OF NORTH OLMSTID <br />NOVEMBER 16, 1993 <br />Present: Council President Boehmer, Council Members Babas, Leonard, Lind, <br />McKay, Musial, Nashar, Saringer <br />Also Present: Mayor Ed Boyle, Law Director Michael Gareau, Clerk of Council <br />Barbara Seman <br />Council President Boehmer called the meeting to order at 8:02 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience Caere invited to join Council in reciting the Pledge of <br />Allegiance to the Flag. <br />The minutes of the meeting of November 3, 1993 were approved as written. <br />Mr. Boehmer announced that Ordinance No. 93-139 would be passed under suspension <br />of the rules. <br />Mayor Boyle reported: 1) On behalf of the Town Club, Mrs. Crider has donated an <br />American Flag to the city. <br />2) The employee suggestion program is now under way. A meeting was held with all <br />Directors and Department Heads to explain the program and to discuss methods of <br />reviewing and implementing suggested plans. Suggestions are already com3.ng in <br />from employees in various departments. <br />3) Met with representatives of Squire, Sanders & Dempsey today to discuss a <br />variety of topics; mainly, projecting borrowings and the senior housing complex. <br />4) The opening on the Planning Commission will be filled after the Wal-Mart issue <br />is concluded. Candidates for the Planning Canmi.ssion will be presented to the <br />members for individual and independent comments to the Administration. The <br />Commission will not be asked to vote on the candidates. <br />5) The North Olmsted Municipal Bus Line was featured in a recent issue of Bus <br />World, a national publication for bus managers.. The article discussed reverse <br />privatization at the North Olmsted Municipal Bus Line. <br />6) The World Health Organization has recognized December 1, 1993 as "World Aids <br />Day" in order to focus an encouraging governments, communities ar~ci individuals to <br />talk about Aids in an effort to stop the spread of this disease. It is estimated <br />that there are 14 million people infected with the HIV virus, and this virus has <br />caused a resurgence of tuberculosis. <br />7) In compliance with the Charter, the Mayor has officially reappointed all <br />current Directors to serve during the next term beginning January 1, 1993. <br />Law Director Gareau reported: 1) The Mayor has acted properly in reappointing <br />the Directors according to the City Charter. This provision of the Charter had <br />previously been interpreted by the Supreme Court in Corrigan vs. Noble. <br />2) With regard to the Nova case, their attorney has stated that with the passage <br />of Ordinance 93-134, they will present their check for tap-in fees to the city <br />and will dismiss their lawsuit. Because the insurance company cooperated with <br />the city and did not begin work on this lawsuit, there will be no cost to the <br />city. <br />3) Once notification has been received from SERB as to the di~nissal of the fire- <br />fighters request to reopen negotiations with regard to smoking, the declaratory <br />judgment action filed by the city will be dismissed. <br />
