<br />MINUTES OF THE PUBLIC HEARING <br />NOVF~ER 16, 1993 <br />7 P.M. <br />Present: Council President Boehmer, Council Members Bahas, Leonard, Lind, <br />McKay, Musial, Nashar, Saringer <br />Also Present: Clerk of Council Barbara Semen <br />Council President Boehmer called the Public Hearing to order at 7 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />The Public Hearing was held to discuss Ordinance 93-104, an ordinance amending <br />Section 1139.01 (B) of the North 0]msted Zoning Code, entitled "Permitted <br />Buildings and Uses," for purposes of restricting the locations of used car lots <br />in the City of North Olmsted. <br />Members of Council discussed whether a current used car lot would be grand- <br />fathered under this legislation. The Affordable Cars business on Lorain Road. <br />will be a possible candidate for grancifathering. <br />Mr. Leonard said he thought that the legislation was elitist. He feels that this <br />problem should be taken care of through proper zoning. Mrs. Beringer felt that <br />the legislation was to avoid having used car lots spring up on vacant lots <br />throughout the city. <br />Councilman-elect Duane Limpert read a letter on this subject from the president <br />of the Chamber of Commerce. (Letter is attached) <br />Mrs. Beringer commented that a car dealership that wanted to open a used car lot <br />not contiguous to the dealership could apply for a variance from the Board of <br />Zoning Appeals. <br />Mr. Nkxsial.questioned how the restriction of the location of used car lots <br />related to the safety, health and welfare of the citizens of North Olmsted. Mrs. <br />Saringer felt it had to do with the beautification of the city. Mrs. Bahas felt <br />there were safety concerns with cars being parked up close to the sidewalks. She <br />also questioned whether used car lots caused an increase in Police surveillance. <br />Mrs. Saringer reminded Council that the legislation had been approved by the <br />Planning Commission and the BZD Committee. She suggested that Council further <br />discuss the issue in caucus where Law Director Garesu would be available. <br />President Boehmer adjourned the Public Hearing at 7:15 p.m. <br />,--~ <br />~~ <br />Bar~ara L.
