Council Minutes of 5/16/95 <br />Mayor Boyle presented proclamations to the Honorary Mayors Becky Hoelter and Ron <br />Bokan in recognition of their achievements in Scouting. The 1995 Honorary Officials <br />were congratulated by all present. <br />Mr. Boehmer introduced the 1995 North Olmsted Citizen of the Year, Mr. Roy Seitz. <br />Mayor Boyle presented a proclamation to Mr. Seitz in recognition of his many <br />contributions to the community. Mr. Seitz, a 37 year resident of North Olmsted, has <br />vohmteered his time and energies for many community activities such as the St. Vincent <br />De Paul Society, an organization he has served for 15 years by supervising support groups <br />to gather food, clothing, toys and money for needy families. Mr. Seitz has also been an <br />active participant in Catholic Charities, the Bishop's Hunger/Housing Committee and the <br />North Olmsted Senior Citizen Advisory Board. Mr. Seitz received the heartiest of <br />congratulations from Council and all present. Mr. Seitz expressed his thanks and <br />recognized the contribution of many voh~nteers who had helped him through the years. <br />REPORTS <br />Mayor Boyle: 1) He has been working on the budget and appropriations and will present <br />this information to Council tomorrow evening at the Finance Committee meeting. <br />Law Director Gareau: 1) The city's insurance company, along with the Law Department, <br />is handling the "Hughes I" case which was filed against the city and several Police officers <br />regarding an investigation into the activities of a Police officer serving his probationary <br />period. A motion for summary judgment was filed and granted on behalf of the city but <br />not the individual officers. The Law Department is considering taking an interlocutory <br />appeal to the U. S. Court of Appeals, Sixth Circuit, relative to this issue. The `Tiughes II" <br />case involves the destruction of documents produced during the investigation of the <br />officer during his probationary period. The documents were destroyed when Mr. Hughes <br />was made a permanent employee. This action prompted the second lawsuit which claimed <br />the city was liable under the statute for $1,000 as a liquidated penalty or damages and was <br />also liable for attorney fees. Because of the amount, this case was not turned over to the <br />insurance company. The Law Department filed a motion for summary judgment in the <br />Common Pleas Court claiming that the Statute of Limitations had passed with respect to <br />that matter. This past week, a ruling was received from the Common Pleas Court granting <br />the motion for summary judgment and dismissing the case. <br />2) A brief has been filed with the Supreme Court opposing a jurisdiction in the Eliza <br />Jennings case. Also, a brief was filed in support of our jurisdiction regardmg the issue of <br />post-judgment interest. It will be several months until we know if the court plans to take <br />this case under consideration. <br />Finance Director Burns: 1) On the agenda are Ordinance Nos. 95-69 through 95-84. <br />These ordinances totaling $28,785,000 represent the rollover of existing notes of <br />$29,035,000--accounting for spay-down of $250,000. These notes will be combined with <br />the legislation authorizing 1995 borrowing for a consolidated issue of $35,310,000. The <br />~,, anticipated closing for these notes is June 21, and the official statement will be ready by <br />2 <br />
