Council Minutes of 10/15/96 <br />5) The "State of the City' address will be presented to the Chamber of Commerce on <br />:~ Thursday, October 17. Copies of the speech will be given to Council members. <br />6) Along with the Law Director and Finance Director, he will be going to New York next <br />week to make presentations to Moody's, Standard & Poor and three insurance companies <br />regarding the city bond rating. <br />7) Mr. James Hines, Chairperson of the Civil Service Commission, has resigned because <br />he is relocating to the Columbus area. Mr. Ernest Cummings has been appointed to fill <br />the vacancy on the commission. <br />Law Director Gareau: 1) This past week a legal opinion was issued with regard to the <br />possibility of excluding females from being eligible to work as corrections officers since <br />most of the jail prisoners are male. His legal opinion stated that we cannot discriminate <br />against females. If females can be police officers, then they can be corrections officers. <br />2) Another legal opinion issued last week dealt with the dispute over the eligibility list for <br />Lieutenant in the Fire Department. The Civil Service Commission had been verbally <br />advised as to how to resolve the problem with respect to the oral examination. The <br />written opinion has now been issued and is on file. <br />3) Stipulations have been prepared and submitted in the Fattlar case. Some time after <br />October 24, the Court of Appeals will appoint a special commissioner who will hold an <br />evidentiary hearing. <br />4) As the Mayor reported, much time has been spent preparing for the presentation to the <br />bond rating companies and insurance companies in New York. <br />5) Tomorrow a brief and a declaratory judgment action regarding an AFSCME health care <br />issue will be filed. <br />6) An executive session will be held this evening to discuss possible litigation involving a <br />firefighters grievance and a pending zoning issue. <br />Finance Director Burns: 1) At the last Council meeting, it was reported that we had <br />pending before the Ohio EPA a request for an Ohio Water Development Administration <br />loan. We were hoping to make the September approval meeting for a loan of <br />approximately $1.2 million at an interest rate of 4.04%. However, the application did not <br />make the September meeting but will be heard on October 31. The amount of the loan <br />will be $1,145,000, and the interest rate will be 4.12%. <br />2) The 1993 and 1994 audits have been released, and they are both clean opinions. <br />3) The Auditor of State's field staff is wrapping up work on the 1995 audit. The post- <br />audit meeting will probably be held in two weeks, and the audit should be released about <br />two weeks after the meeting. We anticipate that the 1995 audit will also be a clean report. <br />Mr. Musial, Chairperson of Building, Zoning and Development Committee: 1) The <br />committee met on October 14. In attendance were Council members McKay, Nashar and <br />Musial; Service Director Bohlmann; Assistant Engineer McDermott; Building <br />Commissioner Conway. The following items were discussed: <br />a. Fraternal Insurance Company, Orthodox Society of America's proposal to convert a <br />residence at 29510 Lorain Road into an office building.
