Council Minutes of 10/15/96 5) The "State of the City' address will be presented to the Chamber of Commerce on :~ Thursday, October 17. Copies of the speech will be given to Council members. 6) Along with the Law Director and Finance Director, he will be going to New York next week to make presentations to Moody's, Standard & Poor and three insurance companies regarding the city bond rating. 7) Mr. James Hines, Chairperson of the Civil Service Commission, has resigned because he is relocating to the Columbus area. Mr. Ernest Cummings has been appointed to fill the vacancy on the commission. Law Director Gareau: 1) This past week a legal opinion was issued with regard to the possibility of excluding females from being eligible to work as corrections officers since most of the jail prisoners are male. His legal opinion stated that we cannot discriminate against females. If females can be police officers, then they can be corrections officers. 2) Another legal opinion issued last week dealt with the dispute over the eligibility list for Lieutenant in the Fire Department. The Civil Service Commission had been verbally advised as to how to resolve the problem with respect to the oral examination. The written opinion has now been issued and is on file. 3) Stipulations have been prepared and submitted in the Fattlar case. Some time after October 24, the Court of Appeals will appoint a special commissioner who will hold an evidentiary hearing. 4) As the Mayor reported, much time has been spent preparing for the presentation to the bond rating companies and insurance companies in New York. 5) Tomorrow a brief and a declaratory judgment action regarding an AFSCME health care issue will be filed. 6) An executive session will be held this evening to discuss possible litigation involving a firefighters grievance and a pending zoning issue. Finance Director Burns: 1) At the last Council meeting, it was reported that we had pending before the Ohio EPA a request for an Ohio Water Development Administration loan. We were hoping to make the September approval meeting for a loan of approximately $1.2 million at an interest rate of 4.04%. However, the application did not make the September meeting but will be heard on October 31. The amount of the loan will be $1,145,000, and the interest rate will be 4.12%. 2) The 1993 and 1994 audits have been released, and they are both clean opinions. 3) The Auditor of State's field staff is wrapping up work on the 1995 audit. The post- audit meeting will probably be held in two weeks, and the audit should be released about two weeks after the meeting. We anticipate that the 1995 audit will also be a clean report. Mr. Musial, Chairperson of Building, Zoning and Development Committee: 1) The committee met on October 14. In attendance were Council members McKay, Nashar and Musial; Service Director Bohlmann; Assistant Engineer McDermott; Building Commissioner Conway. The following items were discussed: a. Fraternal Insurance Company, Orthodox Society of America's proposal to convert a residence at 29510 Lorain Road into an office building. The headquarters of this 2
