Council Minutes of 6/3/97 <br />which is related to Ordinance 97-41. It was pointed out that the contents of the proposed <br /><.rr lease is irrelevant to the proposal of AT&T as is also the distribution of any lease funds. <br />The proposal before BZD was heard by the Planning Commission on April 8, 1997. It <br />involves leasing the space approximately 40 feet square with an equipment shelter of about <br />12x18x10 feet. A security fence would be installed on the perimeter of the square to <br />prevent vandalism. The Planning Commission unanimously approved the AT&T North <br />Olmsted Clague Park proposal to install a wireless tower in the park with the inclusion <br />that utilities would be brought in underground, that the light be down-lighting and will not <br />spill over onto the adjacent property, that the landscaping will be maintained by AT&T <br />and that the landscape drawings are to be presented to the Architectural Review Board, <br />and upon Architectural Review Board's approval, the motion would be valid. The <br />Architectural Review Board considered the AT&T proposal on April 16, 1997. The <br />discussion involved the type of fence, inclusion of mounding and landscaping. A motion <br />was made in ARB to accept the concept for the landscaping and fencing around the <br />AT&T structure in Clague Park with the recommendation that the fencing be a masonry <br />fence, 10 feet in height, with landscaped buffering around the east, south and west side of <br />mounding--the mounding being 3 or 4 feet tall--with landscaping on top of the mound and <br />other landscaping to shield the building. The vote was split: two for and two against. <br />Theoretically, since the ARB didn't give its approval, there was not valid motion from the <br />Planning Commission. Discussion ensued amongst the BZD. It was pointed out that the <br />proposed lease agreement was being voted on the next night and would be beneficial to <br />provide Council with a recommendation of BZD. BZD decided that we would treat the <br />motion of ARB as a neutral decision and take the Planning Commission and ARB motion <br />under consideration for a BZD decision. A motion was made by Mr. McKay and <br />seconded by Mr. Nashar that the BZD recommend approval of the AT&T proposed <br />location of a monopole in Clague Park at the designated location subject to the <br />recommendation of the Police Department from a security point of view as to which type <br />of fencing should be erected around the periphery and further subject to the <br />recommendations of the Planning Commission and approval of the landscaping by the <br />ARB not inconsistent with this motion. The BZD Committee vote was two to one, with <br />Mr. McKay and Mr. Nashar voting in favor and Mr. Musial voting against. On behalf of <br />Mr. McKay and Mr. Nashar, Mr. Musial moved to place before Council the aforesaid <br />motion of Mr. McKay. The motion was seconded by Mr. McKay. Roll call: Musial, no; <br />McKay, yes; Limpert, yes; Nashar; yes; O'Grady, yes; Saringer, no. The motion passed <br />with four affirmative votes and two negative votes. <br />2) Proposed revisions for the new and revised Chapter 1305 of the Building Code of the <br />City of North Olsmted, Ordinance No. 97-27. This ordinance reflects the review and <br />update of the one, two and three family dwelling code so as to maintain current standards <br />in the building industry. The BZD Committee commented that chimneys, flues and vents <br />should be enclosed in a masonry-type construction so as to be shielded from view. The <br />committee felt anew section of the code whereby the inspection record would be made <br />available by accessing the Internet to ascertain how the inspections were progressing was <br />interesting.
