Council Minutes of 5/7/97
,,~ AT&T Wireless proposal for Claque Park, Mayor Boyle said a company representative
had been quoted in the Westlife as saying the administration suggested the Claque Park
site. This is not true. The area fell within their grid, and they approached the city. We
have been negotiating the proposal and have been looking for other sites. A retraction has
been written by AT&T Wireless and will be published in the next issue of the Westlife.
Commenting on Mayor Boyle's report regarding the ballfield at Birch School, Mr. Musial
said that the BZD Committee does appreciate the fact that the city needs more baseball
fields. He personally appreciates that more than most people because his sons played hot
stove baseball and he was a team manager. However, the committee also had the
responsibility of looking out for the interests of the residents and spent a great deal of time
working with them and the Hot Stove League to reach a solution, which he believes was
accomplished. The permanent water line was a very strong recommendation by the
Planning Commission. Mr. O'Grady commented that he would like the record to show
that the solution that was finally arrived at originated with Council. Council was looking
out for the best interest of the citizens and for athletic organizations like Hot Stove.
Mayor Boyle said that the permanent water line recommended by Planning Commission
was for a permanent field. His objection is the decision to have a temporary field and
leave a permanent water line there, thus impacting on the school system. The schools
would have to maintain the water tine if the city decided not to allow the baseball field
next year. Also, there was not a recommendation for a properly sized water line. Mr.
McKay commented that at the first meeting held with the Hot Stove League it was
suggested that they install a grass infield. However, they said they could not play on a
grass infield. The committee asked for a permanent water line to protect the area
residents since a school playground was being turned into a ballpark for the entire city,
which changes the entire atmosphere of the area. Mr. McKay noted that he wilt act on
behalf of his residents any time and any place, and he agreed with the Mayor that school
representatives should have been invited to the meeting. Mayor Boyle reiterated that the
problem occurred when a permanent water line was required for a temporary field. Mrs.
Saringer commented she felt that, in addition to the BZD Committee, the issue should
have been referred to the Recreation Committee.
Law Director Gareau: 1) The last hold-out homeowner has now disconnected the cross-
connection into the sanitary sewer system.
2) Last week the Cuyahoga County Commissioners approved the annexation to North
Olmsted of the area of Springvale Country Club that was in Olmsted Township.
3) With respect to the Moran litigation, an answer was filed last week.
4) Regarding the litigation involving a firefighter candidate who filed an age discrimination
case against the city, there had been an original finding that we had discriminated because
of age. However, the city presented sufficient information to get a reversal on that and the
individual has received a 90-day right to sue letter. That should resolve the issue unless
we get a lawsuit.
5) He has chosen three arbitrators for union grievances--two with the police union and one
with the firefighters' union.
,.
3
;~, _
