~, <br />MINUTES OF THE MEETING OF THE COUNCIL <br />~:; OF THE CITY OF NORTH OLMSTED <br />APRIL 15, 1997 <br />Present: Council President Boehmer, Council Members Limpert, Lind, McKay, <br />Musial, Nashar, O'Grady, Saringer <br />Also Present: Law Director Gareau, Clerk of Council Seman <br />Council President Boehmer called the meeting to order at 8:01 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of Allegiance <br />to the Flag. <br />Mr. Lind moved to approve the minutes of the special Council meeting of March 27, <br />1997; second by Mr. O'Grady; motion passed unanimously. <br />Mr. McKay moved to approve the minutes of the Council meeting of April 1, 1997; <br />second by Mr. Nashar; motion passed unanimously. <br />President Boehmer made the following announcements: the next Council meeting would <br />be held on Wednesday, May 7, because Tuesday, May 6, was Primary Election Day; <br />Resolution Nos. 97-25 and 97-30 and Ordinance No. 97-32 would be passed under <br />suspension of the rule. <br />REPORTS <br />Law Director Gareau: 1) The issues dealing with the Moran case have been discussed in <br />the BZD Committee and will be up for consideration this evening. With respect to the <br />federal case pending, the Law Department had asked for an extension of twenty days in <br />order to facilitate the request which will be considered this evening. A request has been <br />made that the plaintiff dismiss the 2506 appeal, which is the appeal from the Board of <br />Zoning Appeals, because the Law Department ruled that submittal to the BZA was not <br />necessary under existing law. <br />2) The Law Department had asked the attorney for Mr. Dooling (Dooling vs. the City of <br />North Olmsted) to dismiss the case because he had filed outside of the Statute of <br />Limitations. The attorney did not dismiss the case, and the Law Department has filed a <br />motion for summary judgment because of the Statute of Limitations and because of the <br />city's immunity. <br />3) The firefighters' union has filed an unfair labor practice against the city because the Fire <br />Chief ordered the firefighters to wear uniforms when they attend training sessions. <br />~. ,~.. r ~.. . <br />
