Finally, on January 29, 1998, a pretrial was held before Judge Daniel <br />Gaul of the Cuyahoga County Court of Common Pleas in the case of North Olmsted Land <br />Holdings Company v. City of North Olmsted. This is the consolidated case which seeks <br />to rezone the "Parcel E" property on Brookpark Road from its present classification of <br />office building district to retain (retail) business district. I was present at the pretrial on <br />behalf of the City, and two other lawyers were present representing North Olmsted Land <br />Holdings Company (hereinafter referred to as "Biskind"). At the pretrial, a settlement <br />proposal was made by Biskind, which would involve developing the subject property <br />partly as retail, partly as a cluster development, and partly as a park: for the use of <br />homeowners in the adjoining subdivision. Judge Gaul asked me to convey the outline of <br />this settlement proposal to you and to inquire whether Council would be amenable to <br />considering a settlement of this lawsuit. If Council is so inclined to consider settlement, <br />the Judge will set a work. session pretrial in his court downtown at which all members of <br />Council will be requested to be present to review the settlement proposal in detail. <br />Accordingly, I recommend that you consider this matter, and then report to the Law <br />Department how you wish to respond to the Judge." <br />Mr. McKay, Chairperson of the Streets & Drainage Committee: 1) Bidding for the repair <br />of Cedar Point Road will be done the latter part of April or the beginning of May. The <br />project will include the renovation of Cedar Point Hill Road from Columbia Road to <br />Ruple Road in the City of Brook Park. The federal government will pay 80% of the cost, <br />the county will pay 10% and the cities will pay $50,000 each. Total cost will be <br />approximately one million dollars. <br />2) This Saturday at 9 a.m., Service Director Bohlmann will conduct a street inspection <br />tour for members of Council and the Finance Director. <br />Mr. Limpert, Chairperson of the Intra-Governmental Relations and Legislation; Long- <br />Range Planning Committee: 1) The committee met on January 26 to discuss the <br />Community Development Block Grant proposals. Present were all members of Council, <br />Safety Director Jenkins, Service Director Bohlmann, Finance Director Copfer, Director of <br />Human Resources Copeland, City Engineer Deichmann, Recreation Commissioner <br />Dolansky, representatives from Horizon's and several citizens. Nine projects were <br />discussed. Four were dismissed as not being doable at this time. The grants are awarded <br />on a competitive point scoring done by the county. There is no definitive cut-off as to <br />where the points will drop off as far as not being able to receive the award. The top five <br />projects, the anticipated points and total cost are as follows: <br />• Clague Road--streets, sewer and sidewalk--93 points. Total cost of the project is <br />$2.1 million. <br />• Mildred, W. 230, W.232--a street and sewer project--92 points. Total cost of the <br />project is $862,000. <br />-a~::; <br />4 <br />
