Councilman Gareau said it seemed that Mr. Break's question was whether a <br />future challenge would be made easier by virtue of the fact that there has been a previous <br />zoning change. He noted that each and every zoning decision on the part of City Council <br />would be subject to the same scrutiny. The response to someone saying that the zoning <br />had previously been one way is that the city believed by changing it they were furthering <br />a legitimate governmental imerest. Councilman 1Vliller said that the second whereas <br />clause specifically says the city does not want this particulaz pazcel in some future date to <br />be used for commercial business activity. The third whereas clause says that the entire <br />area bounded by I-480 to the north, relocated 252 to the west, Butternut Ridge to the <br />south and Columbia Road to the east should remain exclusively a residential enclave and <br />there should be no private commercial development intrusion in the area. <br />Walt Sheffield, 4553 Ashbury Park Drive, noted that Ordinance 99-139 does not mention <br />churches or synagogues and asked if they aze exempt from this. Law Director Gareau <br />answered that a church is a permitted use in a residential district.
