Council Minutes of 9/21/99 <br />Olmsted should pursue a planning advisor, albeit not perhaps through a department of <br />planning and perhaps not through afull-time employee as originally proposed. With <br />four members of Council agreeing that we should proceed in that direction, the joint <br />committees agreed to hold the proposal in committee until such time as it could be re- <br />worked to encompass apart-time position to achieve the purposes as set forth earlier. <br />Mr. Nashar, chairperson of the Public Safety, Health & Welfare Committee: 1) The <br />Safety Committee met on September 15. Present were committee members Miller, <br />Gareau and Nashar and Council members Limpert and Saringer. The committee <br />discussed Ordinance 99-123, an ordinance amending the Traffic Control File for the City <br />of North Olmsted by providing for the installation of a "No Parking" sign on the fire <br />hydrant side with an arrow pointing in a westerly direction between the properties of <br />26646 and 26670 Sweetbriar and a "No Parking" sign on the other side directly across <br />from the original sign in front of 26653 Sweetbriar pointing in the opposite direction. <br />Traffic Engineer Griffith did make the recommended changes to this ordinance. Also, <br />Police Chief Ruple concurred with the change. The committee recommended approval. <br />Councilman Nashar announced that he was proposing a holiday food donation program. <br />He asked residents, Council members, the Mayor and members of the administrative staff <br />who attend regular City Council meetings or meetings of boards and commissions if they <br />would consider bringing a can of food to be donated to our city food bank. This program <br />will begin with the first meeting in October and run through December. All donations <br />will be distributed during the holidays. Human Resources Director Copeland strongly <br />endorses this program as the food bank runs on the very low side during this time of the <br />year-all food donations would be greatly appreciated. <br />AUDIENCE PARTICIPATION <br />Tom Hreha, 6418 Surrey Drive, spoke about Ordinance 99-109 which regulates the <br />outdoor storage of motor vehicles under repair. He said he wanted to applaud Council for <br />considering legislation to keep North Olmsted from looking like a junk yard. No one <br />likes to see unsightly automobiles sitting around. However, he feels that Ordinance <br />74-112 deals with essentially the same thing and could be pretty much summarized in the <br />last sentence that says after the seventh day motor vehicles must be placed within a <br />building or be in an operative and safe condition. He wondered if the old ordinance had <br />been repealed as he believes the new ordinance would be in conflict with this because it <br />allows people to wait 45 days. Mr. Hreha said this may make it difficult for the Police <br />Department to enforce either of them. He would like clarification on this matter. Law <br />Director Gareau said that, when a ordinance is adopted that is the same subject matter as <br />an existing ordinance, it is either repealed specifically or it is repealed by implication. If <br />you have one regulation and then you pass another ordinance dealing with the same <br />subject matter years later that either changes the time or extends the time, then the old <br />legislation is repealed by implication. Over the years, we have had many, many <br />problems trying to deal with that seven day ordinance. Also, he noted that the Police <br />Department does not enforce these regulations. The ordinance is enforced by the <br />Building Department. He does not know how the number of days was arrived at, but <br />8 <br />
