Council Minutes of 9/7/99 <br />proximity to parks, the downtown area and airports; our school system; shopping choices; <br />community organizations; good people. Some of the concerns that were raised-some of <br />which were also identified as strengths-were retail with regard to signs and appearance <br />along Lorain Road; infrastructure; condition of roads; green space-how much land does <br />the city have right now that will be retained as green space; community facilities; parks; <br />traffic and traffic primarily getting in and out of certain roads that are overwhelmed <br />because they were never built to take the volume of current traffic. <br />Mr. McKay, chairperson of the Streets & Drainage Committee: 1) The committee met on <br />Monday, August 30. In attendance were committee members O'Grady, Nashar and <br />McKay; Council members Gareau, Miller and Limpert; Service Director Bohlmann; <br />Building Commissioner Conway; Assistant Engineer McDermott. The committee <br />discussed Ordinance 99-66 which creates new Section 915.19 of Chapter 91 S of the <br />Codified Ordinances entitled "User Charge System." The purpose of the ordinance is to <br />provide for a method of collecting sewer charges that occur between the date of tap-in to <br />the sanitary sewer system and the date that the Cleveland Water Department begins to bill <br />the property owner. If a property owner notifies the City Engineer of the non-billing, the <br />recovery will be limited to one year. If there is no notification to the city, the recovery <br />time shall be limited to a five-year period. The committee recommended approval. <br />President Pro Tem O'Grady explained to the audience that Ordinance 99-SS had been <br />removed from the agenda because answers to questions and concerns raised by a Council <br />member had just been received before the meeting. It was the feeling of Council that <br />they needed more time to review the answers. The legislation will be put back into the <br />Recreation Committee and will be on for third reading at the next Council meeting. <br />Mr. Nashar, chairperson of the Public Safety, Health & Welfare Committee: 1) The <br />committee met on August 30 to discuss Ordinance 99-111. Present were committee <br />members Gareau, Miller and Nashar; Council members McKay, Limpert and Kasler; <br />Police officers Cox and Cook; Safety Director Jenkins, Mayor Musial. Ordinance 99-111 <br />creates a new Section 337.30 of the Traffic Code to prohibit excessively loud playing of <br />boom boxes and other sound devices while operating a motor vehicle. The first offense <br />will be a minor misdemeanor, and the fine will be $75. If the offender is caught again <br />during the next 36 hours, it will be a minor misdemeanor of the fourth degree and a fine <br />of $150 to $500. The committee recommended approval. <br />2) The committee met this evening in a joint meeting with the Finance Committee to <br />discuss Ordinance 99-107. This legislation provides for the establishment of a Safe <br />Traffic Oriented Policing ("STOP") Unit. This is aself-sustaining program and will <br />produce revenue for Police Department equipment. The program will help address traffic <br />problem areas in the neighborhoods. The Ohio Department of Public Safety has <br />identified 26 counties as having traffic related problems. Cuyahoga County was on the <br />list, and North Olmsted ranked within the top 12 cities and will benefit from this <br />program. The Police Chief shall assign this unit to officers who are willing to work <br />additional hours prior to the start or at the end of their shift or on off days. <br />~~ <br />3 <br />
