NORTH OLMSTED CITY COUNCIL <br />`'~"°' MINUTES OF THE PUBLIC HEARING <br />JANUARY 19, 2000 <br />7 P.M. <br />Present: Council President Saringer, Council Members Gareau, Kesler, Limpert <br />McKay, Miller, Nashar, O'Grady <br />Also Present: Mayor Musial, Clerk of Council Semen <br />Council President Saringer called the public hearing to order at 7 p.m in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />President Saringer announced that the public hearing was being held with regard to <br />Ordinance 98-130 which amends the Zoning Code to add a new Chapter 1151, `°Wireless <br />Telecommunications Facilities Regulations and Wireless Telecommunications Facilities <br />Overlay District." <br />AUDIENCE PARTICIPATION <br />Councilman Gareau <br />• This legislation is a proactive approach to future development and construction of <br />towers in North Olmsted since the city does not have regulations in place at this time. <br />The companion Ordinance 98-131 will supplementally zone certain parcels into the <br />WTFO District. <br />• There is a tower in Claque Park; however, there is no pending proposal for another <br />tower in the city at this time. <br />Councilman McKay <br />• There currently is a tower in Claque Park and at one time there had been a proposal to <br />construct one on Recreation Center property, which was not a very good place. <br />Consequently, it was determined that we need regulations and a specific zone for <br />these towers. <br />Councilman Nashar <br />• These ordinances are being introduced to protect the residents of the city. <br />Councilman O'Grady <br />• As he understands the Federal Telecommunications Act of 1996, the city is permitted <br />to regulate towers but not restrict them. He asked consultant, Todd Hunt, who was <br />present to speak about the difference between restricting and regulating. <br />
