Council Minutes of 1/4/2000 <br />Mr. Gareau, chairperson of the Building, Zoning and Development Committee: 1) The <br />committee met on January 3, 2000. Present were committee members Gareau, Miller and <br />McKay; Council members Limpert, Nashar and O'Grady; Mayor Musial. There were <br />two items on the agenda,: <br />• Ordinance 99-139, "An ordinance creating a new and reviewed Chapter 1140 of the <br />Planning and Zoning Code of the City of North Olmsted entitled `Public Facilities <br />Overlay District' and declaring an emergency." This ordinance, if approved, will <br />create an overlay zoning classification which will establish a secondary zoning <br />classification to permit governmental, civic, health, welfare, educational and <br />recreational facilities in any zoning classification to which the supplemental zone is <br />applied. An overlay zone expands the permitted uses in any zoning classification <br />without changing the underlying zoning classification of the property. The uses <br />which could be applied to it will be limited to those within the ordinance. Maximum <br />height of any building built within such a district will be 24 feet. There will be <br />minimum side yards and rear yards and there is additional language requiring <br />buffering and adjacent properties. Following discussion, the committee unanimously <br />recommended approval of Ordinance 99-139. <br />• Ordinance 99-140, "An ordinance providing for the amendment of the zone map of <br />the City of North Olmsted in order to supplementally zone the hereinafter five parcels <br />of real property located east of relocated State Route 252 and south of I-480 so as to <br />include them within the Public Facilities Overlay District (PFO) of the City of North <br />Olmsted." Ordinance 99-140 applies the Public Facilities Overlay District which was <br />created by Ordinance 99-139 to five parcels of residentially zoned property east of <br />relocated State Route 252 and south of I-480. This property is the site of the <br />proposed future Greater Cleveland Regional Transit Authority Park-and-Ride. If <br />Ordinance 99-140 is passed, the land will still be zoned residential. However, the <br />Park-and-Ride would be a permitted use on the land. In the event the Park-and-Ride <br />is not built, Council retains the authority to repeal the supplemental zoning. It is <br />important to understand that the only permitted uses on that property are those <br />expressly set forth in the ordinance which are governmental in nature as well as the <br />underlying residential use which existed previously. After discussion and input from <br />several residents who live in the area which would be affected by the Park-and-Ride, <br />the committee recommended approval by a vote of two to one with Ward IV <br />Councilman Dean McKay dissenting. <br />AUDIENCE PARTICIPATION <br />Dennis Lambert, 25057 Carey Lane, spoke on the amendment to the Rules of Council. <br />He noted that in some cities the president of Council makes the choice of committee <br />membership. Mr. Lambert said in essence what Council has done is put the most senior <br />member of Council as actually the chair of the Council since the senior person makes the <br />first choice. If he lived in a ward represented by a junior Councilman, he would be <br />worried. He feels this entices baiting, bidding and deal making and discourages public <br />debate. He believes this leads to question how the legislation itself is handled since it is <br />~~. the committees that allow the legislation to get to the floor of Council.
