Council Minutes of 10/2/2001 <br />the County Prosecutor's ruling, he was told this afternoon that the Boazd of Elections has <br />refused to establish the precincts within the new ward boundaries. The filings in <br />Columbus will be done by Calfee, Halter &c Griswold. We aze going into the Supreme <br />Court tomorrow morning to ask for an immediate hearing and a ruling on the issue with <br />respect to stopping the absentee ballots from going out until we can get a ruling on the <br />duties and obligations of a Board of Elections to do their job. These Boazd of Elections <br />issues are determined in very short order. Five days after the complaint is filed, the <br />respondent, that being the Board of Elections, must file their answer. The city then has <br />three days to submit evidence and briefs, and the board has three days after that to submit <br />evidence and briefs. It's unfortunate that we have been put in this position. It is <br />unfortunate that the City of Fairview Park has been put in that position, and the City of <br />Euclid. He can't understand it, and there are a lot of people that don't understand it. <br />Hopefully, we can get this straightened out because it impacts very severely on the entire <br />City of North Olmsted. It will place in jeopardy all of the races in the Council. It will <br />place in jeopardy the constitutional rights of everybody who has been shifted from one <br />ward to another-they will not be afforded due process or equal protection under the law <br />to vote for the people who are their representatives. He does not think that the Board of <br />Elections understands that. If they understand it, they sure do not appreciate it. <br />2) Tomorrow morning apre-trial hearing will be held in front of Judge Corrigan in the <br />Probate Court. The city has acquired all of the pieces of land for the library except the <br />C & C Realty property. He and Assistant Law Director Jim Dubelko will attend to <br />represent the city. <br />3) With respect to the Claque Road widening, he has sent out notices to all parties <br />concerned and asked for a response within seven days to indicate what their intentions are <br />with respect to the acquisition of their property for that project. Four of the nine people <br />have responded. Hopefully, we can still get that project under way this year. <br />4) Recently, he shared with members of Council information with respect to the issues <br />the city has been dealing with regarding the library board It has been almost a year since <br />the library issue passed. He, the Mayor and Service Director have been working <br />feverishly trying to get agreemems to get the architect hired, construction manager hired <br />and to get prepared to go out for bids. A couple of weeks ago, he shared with Council a <br />letter regarding those issues, and he can report that he still has not received an answer <br />from the library board. They still have refused to negotiate with the city. The legislation <br />which authorizes the Mayor to enter into an agreement with the people the city has <br />chosen as the construction manager should proceed through the proper channels. He will <br />attend the committee meeting and explain what the circumstances aze and apprise <br />Council of the facts. Presumably, both the Mayor and the Service Director will also give <br />their opinions with respect to the qualifications of these individuals. After that is done, <br />and all CounciYs questions are answered, then the ordinance should be adopted. <br />Finance Director Copfer: 1) The Revenue and Expenditure reports were distributed to <br />Council today, and the comparative report for the key General Fund characteristics for <br />property taxes, municipal and estate taxes were distributed this evening. <br />President Saringer, chairperson of the Cable Advisory Committee: 1) The committee met <br />on Monday, September 24.
