Council Minutes IO/15/2002 <br />belts save lives, and that this city has the enforcement power to save lives. He stated that <br />a person who uses their seat belt is ten times more likely to be saved and/or incur less <br />severe injury than one who does not. Councilman Limpert reiterated his concern that, if <br />our worry is children, why school buses do not have seat belts. It was suggested that, <br />although this is a very legitimate concern, it is to be addressed separately. Also, the <br />Council cannot govern the construction of the buses but can offer some control over the <br />use of already existing and mandatory belts. Another issue was raised with regard to <br />excessive ticketing in North Olmsted and the perception that this would be a method for <br />issuing more tickets. Officer Holly mairrtains that it is simply not the case here. His <br />suggestion was that Council may want to consider making the first year of enforcement a <br />warting period as opposed to ticketing. After that year is up, it is important to note that a <br />safety belt violation does not incur points on a license. Officer Holly's intention in <br />promoting this issue is strictly to save lives, particularly targeting his efforts towards the <br />lives of children who cannot help themselves. Therefore, the warning period was a <br />suggestion. In reply to a question regarding fatalities occurring in North Olmsted in the <br />last two to three years, the committee was told the city has on the average of six to ten <br />fatalities a year. It was requested that the North Olmsted Police Department provide the <br />number of tickets written last year which included a seat belt violation. The committee <br />will reconvene on the approach to this ordinance--whether it is to go forward as a <br />warning system or some other form. <br />2) During caucus this evening, the committee discussed a liquor permit that had been <br />previously discussed. It is a request for a D1, D3 and D3A liquor permit for Pepper <br />Joe's, which is to be located at 24532 Lorain Road above the auto repair shop. Questions <br />that were being discussed with regard to this were the lack of sufficient parking and also <br />location of a facility right above an auto repair shop. The Law Department has assured <br />the committee that those issues can continue to be considered by the city boards and <br />commissions and that, in fact, the liquor permit is the only thing that is before this <br />Council. It is the recommendation of the Law Department that under the state code <br />Council has no grounds for objecting to this permit at this point of time. Those other <br />issues remain alive and can be addressed in other forums. Council member Kasler <br />moved that Council have no objection to the D3, D3A and D1 liquor permits for Pepper <br />Joe's at 24532 Lorain Road. The motion was seconded by Councilman Miller and passed <br />unanimously. <br />Councilman Dailey, chairperson of the Transportation Committee: 1) The committee met <br />on Tuesday, October 8, to discuss Resolution 2002-138, a resolution authorizing the <br />Mayor to make emergency upgrades to the one underground storage tank at the North <br />Olmsted Muzucipal Bus Line Garage and the two underground storage tanks at the <br />Service Garage without public bidding and declaring an emergency. In attendance were <br />committee members Dailey and McKay; Councilmen Gareau and Nashar; President of <br />Council O'Grady; Finance Director Copfer, Law Director Dubelko, City Engineer <br />Deichmann and NOMBL Manager Terbrack. Discussion cerrtered around the fact that it <br />is not the tanks that need replacing, but the piping for the underground tanks, Mr. <br />Terbrack advised that there is currently $10,000 available from the NOMBL maintenance <br />fund for the repairs to their one tank and that quotes they had received were between <br />$8,000-$14,000 for the work to be done.
