Public Hearing Minutes <br />Ordinance No. 2002-118 <br />Page 4 <br />~.. <br />Councilman Limpert said it was his understanding that the legislation is to address the <br />court's mandates, and it is difficult to think of everything. The possibility for <br />misinterpretation does exist. He asked Mr. Burns if his comments also included input <br />from the Chamber of Commerce. Mr. Burns said it did. Mr. Limpert asked that Mr. <br />Burns' list of comments be looked at just to make sure there are no major problems. Mr. <br />Smerigan noted that these items had been discussed at some length. He doesn't pretend <br />to be perfect, and he is certainly willing to meet with the Chamber just like they met <br />with the neighbors, property owners and the developer. He tried to get input from <br />everybody who was involved and interested, and this was a very public process. Part of <br />the reason why there are additional provisions in the Mixed Use D District is because <br />these are districts that anticipate a development plan. They are rezonings that come forth <br />with afull-blown plan attached to them. Because of the litigation and the direction from <br />the court, we are in a position of placing zoning on the property without that plan in <br />place. In order to address that lack of a plan, it was necessary to incorporate a number of <br />criteria and standards to help clarify what the development procedure for the site was <br />going to be that would normally have come out as part of the plan negotiation and review <br />process. Law Director Dubelko noted that Mr. Burns had previously presented his <br />comments to the Law Department. Those commems and issues were discussed by the <br />Law Department and Mr. Smerigan, and no changes to the legislation were <br />recommended. <br />Mr. Burns commented that it should be kept in mind, when anything is done to the <br />Zoning Code, it is not for a specific parcel, it is for the entire city. <br />President O'Grady adjourned the public hearing at 7:29 p.m. <br />'Barbara L.
