Council Minutes of 4/15/2003 <br />..~. been turned over to the city's contractor, and a demand made to the contractor to hold the <br />city harmless in the matter. That is part of our contract with that contractor. <br />6) Assistant Law Director O'Malley has transmitted an offer to the Assembly of God in <br />the amount of the appraisal obtained by the city for the easement area that the city <br />obtained in connection with the Columbia Road storm sewer project. When we do <br />conduct an appraisal, we have an obligation to tell the property owner how the appraisal <br />comes back and then offer that amount. That is just compensation as we see it. <br />7) On April 8, the city was put on notice of a claim by an individual who was injured <br />while exiting a NOCOP van. The person's attorney wanted to take a deposition to <br />perpetuate the testimony of the individual who was facing serious surgery. The matter <br />was handled by the city's insurer who provided an attorney for the deposition, and the <br />claim will be defended by the city's insurer. <br />8) On April 7, he provided the Civil Service Commission and the Safety Director with <br />advice regarding proper procedure to follow with respect to the upcoming Assistant Fire <br />Chief promotional examination. <br />9) On April 7, he provided legal advice to the Mayor and the Service Director regarding <br />legal issues and requiremeirts for having a Class 4 licensed operator in charge of our <br />Class 4 Waste Water Treatment Plant. <br />10) He attended a Board of Control meeting on April 8. Qn April 9, a meeting of <br />department heads was held at which the City Engineer was introduced. <br />11) On April 10, he attended a Law Directors' Association luncheon. The speaker made <br />a presentation on federal law requirements relating to employees on military leave. North <br />Olmsted complies with that federal law. <br />12) On April 10, he attended a DARE mock trial at St. Brendan's. It's an event that is <br />put on each year by Police Officer Glenn Adamson and Assistant Law Director Bryan <br />O'Malley, and they always do a great job on it. He has participated on a few occasions as <br />has Councilwoman Kesler. <br />13) He has asked the Safety Director to provide the results of his investigation regarding <br />damage allegedly done to the Springvale parking lot by a city contractor so that he may <br />evaluate whether the city has a claim which should be pursued in this matter. Thank you <br />to Council member Kesler for her input regarding this matter. <br />14) The collective bargaining cycle for 2003-2004 will soon begin. The first contract the <br />city has for re-negotiation is that of the NOMBL employees as the contract expires on <br />July 31, 2003. Those negotiations will probably begin in May, and will be followed by <br />the various police and fire contracts which expire on December 31, 2003. The final two <br />contracts, Service and ClericaUTechnical, each expire on June 30, 2004. As the city does <br />not have the funds to consider hiring outside negotiators, he will be participating as Law <br />Director along with the Finance Director and the Personnel Director as the common <br />nucleus in all of the contract negotiations on behalf of management. <br />Councilwoman Kesler inquired of the Law Director if it would be appropriate to refer the <br />comp time policy back to the Finance Committee. She and Mr. Dubelko have discussed <br />that the idea of looking into this issue is to create a consistent policy that applies to the <br />appropriate groups. She had previously requested of Mr. Dubelko that he not only <br />request the hours that have been accumulated in the various departments, but also the <br />policies that have been enacted so as to compare those to see whether they are consistent. <br />4 <br /> <br />
