MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />JANUARY 21, 20113 <br />Present: President of Council O'Grady, Council Members Dailey, Gareau, Kasler, <br />Limpert, McKay, Miller, Nashar <br />Also Present: Law Director Dubelko, Finance Director Copfer, Clerk of Council Seman <br />President of Council O'Grady called the meeting to order at 8 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of <br />Allegiance to the Flag. <br />The minutes of the Council meeting of December 3, 2002 were approved as written. <br />President O'Grady announced: Res. 2003-3, 2003-4, 2003-5, 2003-10 and Ord. 2003-7 <br />will be passed under suspension of the rules; there will be a public hearing on February <br />18, at 6:45 p.m., for the consideration of Ordinance 2002-186 which deals with the <br />rezoning of the Rockwynd cluster development; there will be a second public hearing on <br />February 18, at 7:15 p.m., for Ordinance 99-77 which deals with commercial lighting. <br />REPORTS <br />Law Director Dubelko: 1) During the period of January 9 through 17, he provided <br />various legal memos to the Service Director regarding opening, evaluating and applying <br />the city's minimum contractor responsibility standards to the library construction contract <br />bids. The Board of Control was scheduled to review the bids and make an award on <br />January 13; however, because of a need to obtain supplemental information from all the <br />bidders to determine compliance with the city's minimum contract responsibility <br />standards ordinance (Section 111.02), the item was taken off the Board of Control <br />agenda. <br />2) During the period January 8 through 10, he reviewed, revised and approved the R. E. <br />Warner contract dealing with engineering consulting services for the city. <br />3) On January 10, he provided legal advice to the new Service and Safety Directors <br />regarding implementing snow storm emergency regulations. <br />4) On January 13, he attended the Board of Control meeting. As mentioned above, the <br />library construction contracts were removed from the agenda. However, the board <br />reviewed and approved a sodium aluminate contract for one year, with an option for a <br />second year renewal at the same price; the new generator for the LeBern pump station, <br />which had previously been authorized by City Council; the Perk change order No. 3 for <br />the Claque Road widening project. <br />5) On January 20, he issued legal opinion 2003-1 regarding authority of administrative <br />officials to cancel city contracts authorized by City Council.
