Council Minutes of 10/5/2004 <br />and a copy of the complaint in the State ex. rel. Ganley Real Estate Company vs. the City <br />,,,. of North Olmsted case. The case was filed in Common Pleas Court and assigned to <br />Judge Daniel Gaul. Essentially it seeks a declaration that the city's split zoning of Ganley <br />property is unconstitutional and a writ of mandamus directing the city to commence an <br />appropriations proceeding in probate court to compensate Ganley for the value of the <br />land taken from it as a result of the alleged unconstitutional zoning. The city's answer to <br />this complaint is due to be filed on or before October 25. (He will speak with Council <br />during an executive session regarding litigation strategy as well as the resources he <br />believes the city will require in order to maximize its chances of successfully defending <br />this litigation.) <br />2) A collective bargaining update: On September 26, he reviewed his proposed draft of <br />the new fire fighter labor contract against the draft independently prepared by the IAFF <br />local president. He prepared and sent a memo to the union president suggesting an <br />approach to resolving the differences regarding final language for this labor contract. On <br />September 27, the management team completed negotiations with the clericaUtechnical <br />unit. The union reps will be taking a proposed new contract to the membership. If <br />approved, it will thereafter be submitted to Council for approval. October 4, he received <br />a communication from the OPBA representative regarding the dispatchers' labor contract <br />that was sent to their representative in mid-August. Now that he has the union's <br />comments regarding the draft, he can begin to resolve some of the minor differences on <br />final contract language. <br />3) September 28, he attended a Board of Control meeting followed by a directors' <br />meeting. <br />4) On September 28, he attended a meeting with RTA officials regarding the proposed <br />elimination or modification of bus route No. 53. At the meeting, RTA indicated that it <br />would go forward and reschedule the public hearing on this matter. <br />5) On September 29, he attended another meeting with RTA officials to discuss renewal <br />of the operating agreement. He does not think it prudent to comment on the negotiations <br />other than to say it's not going to be a walk in the park. There are a number of critical <br />issues that must be resolved before the city's team can recommend to the Mayor to bring <br />a new operating agreement to Council for approval. Hopefully, it will be ready for <br />presentation in November. <br />6) September 30, he provided legal advice to the Safety Director regarding two step-three <br />hearings involving grievances from the Fire Dept. <br />7) October 1, along with a number of other directors, he attended the N. O. Chamber of <br />Commerce golf outing at Springvale. It was a nice event, and the weather was good. It <br />was a nice opportunity to mix with other directors in an informal setting. He commends <br />Human Resources Director Don Copeland for encouraging all directors to participate <br />regardless of their golfing skill level. <br />8) October 4, in the case of the City of North Olmsted vs. Brian Diamond, the Law Dept. <br />recovered $621.14 for damage caused to a city police vehicle. <br />9) October 4, he attended a meeting of the city's records commission at which the <br />commission approved RC 1 and RC2 applications submitted by the Finance Director. <br />10) October 15, he attended a directors' meeting. <br />~~ <br />-~,„; <br />5 <br />,~ <br />i <br />
