MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />SEPTEMBER 7, 2004 <br />Present: President of Council O'Grady, Council Members Dailey, Gareau, Kasler, <br />Limpert, McKay, Miller, Nashar <br />Also Present: Law Director Dubelko, Finance Director Copfer, Clerk of Council Seman <br />President O'Grady called the meeting to order at 8:10 p.m. in Council Chambers, 5200 <br />Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />Councilman Gareau moved to amend the agenda to remove Resolution Na. 2004-101 <br />from third reading and Ordinance 2004-119 from second reading. The motion was <br />seconded by Councilman Nashar and passed unanimously. The agenda was amended. <br />The Council meeting minutes of August 17, 2004 were approved as written. <br />President O'Grady made the following announcements: Ordinance 2004-136 would be <br />considered for passage under suspension of the rules; a special Council meeting will be <br />held at 8 p.m. on Tuesday, September 14, with regard to Parcel E. <br />REPORTS <br />On behalf of Mayor Musial who was absent, Law Director Dubelko read the Mayor's <br />report: I want to acknowledge the extensive planning the North Olmsted Community <br />Council ,provided with regards to Homecoming 2004 held last month. The choice of <br />events and entertainment was excellent and provided a diverse selection appealing to all <br />segments of our resident population. The midway was top-notch, and the parade on <br />Sunday afternoon was very enjoyable. Even though we had some periods of liquid <br />sunshine, it only dampened our spirits for a short time. On behalf of the entire City of <br />North Olmsted, we thank you." <br />Law Director Dubelko: 1) Litigation update: There was a new filing against the city in <br />August, Nancy Kovacic vs. Cuyahoga County Department of Children and Family <br />Services, et al. Named as defendants in this action along with the county department <br />were the North Olmsted Police Dept. and the North Olmsted City Prosecutor. This is <br />essentially a custody dispute matter that has boiled over into a civil action. The <br />allegations of the defendants, including municipal defendants, are emotional distress <br />claims, conspiracy claims and various other breach of duties.
