With that, the committee unanimously <br />recommended approval subject to the recommendations of the boards and <br />commissions. Councilman Gareau moved that Council approve the Pepper Joe's <br />project subject to all the recommendations of the boards and commissions and the <br />committee. The motion was seconded by Councilman Nashar. (Councilman Nashar <br />asked that it be noted there is not enough room on the property for large Fire <br />Department equipment to have access. The owner of the property understood that, <br />and it should be noted in the record.) The motion passed unanimously. <br />• Famous Dave's Barbecue, 28410 Great Northern Plaza, formerly the Chi Chi's <br />building. Dave Portus and Elliot Baum presented an exterior renovation of the <br />building. It consists of painted stucco and stone exterior modifications along with a <br />standing seam roof and some wood siding at entrances. The presentation was a very <br />attractive building which will be a nice addition to the area. There was some <br />reluctance on their part to do extensive exterior modifications, but with the guidance <br />of our Planning Director, they realized the benefit of establishing their own identity <br />rather than the distinctive architectural features of the old Chi Chi's building. Mr. <br />Baum explained this would be the most expensive Famous Dave's Barbecue of the <br />over one hundred franchises that they own. There will also be additional new <br />awnings and there will be lighting modifications. We are still waiting on a lighting <br />submittal. Significam landscape enhancements are contemplated and incorporated in <br />the design. Planning Director Wenger noted that the Planning Commission approved <br />the project with the condition that the lighting levels must meet the city requirements, <br />and fixtures would be consistent with adjacent parcels. There was originally some <br />rope lighting which had been incorporated that was taken out. The canopies will not <br />be internally illuminated. Mr. Jesse noted that the canopy as constructed over the <br />entryway, the steel seam roof, did not incorporate snow-stops. There's a significant <br />peak right above the doorway on the sidewalk. This design may cause snow to fall on <br />someone walking in the door. With that discussion, the snow-stops were incorporated <br />into the project. Extensive landscaping will be added along Brookpark Road, <br />including additional trees, perennials, day lilies. The landscaping is going to be <br />designed to continue to bloom throughout the course of the year for color. It should <br />be noted the dumpster area is going to be within the enclosed building. The <br />committee unanimously recommended approval of Famous Dave's Barbecue subject <br />to the recommendations of the boards and commissions and further subject to the <br />installation of a snow-stop system. Councilman Gareau moved that Council approve <br />the renovation project for Famous Dave's Barbecue subject to the recommendations <br />of all the boards and commissions and to the installation of a snow-stop system. The <br />motion was seconded by Councilman McKay and passed unanimously. <br />• Ordinance 2004-119, an ordinance amending Section 1345.01 and 1345.02 of the <br />Building Code to exclude landscaping features from permit and fencing requirements <br />in Section 1345.01 and 1345.02 and declaring an emergency. It was brought to the <br />attention of the Mayor that there have been several variances requested by residents <br />who wish to install small ponds in their backyards. The code as currently written <br />would require fencing around such ponds, and it does not give a lot of discretion to <br />the Building Commissioner to allow for variances in that area.
