<br /> <br /> <br />1113.02 PLANNING AND ZONING CODE 16 <br />1113.02 PURPOSE. <br />,~, The purpose of the Zoning Code shall be to provide by the provisions hereinafter made <br />' for the orderly development of the land within the City and to provide in that manner for the <br />public peace, health, safety, convenience, comfort, prosperity and general welfare of its residents <br />and of the City. <br />~°'"' (Ord. 90-125. Passed 5-21-91.) <br />1113.03 SCOPE. <br />The provisions of the Zoning Code, as may be from time to time amended or <br />supplemented, shall apply to the use of land within the City by the creation of districts defining or <br />limiting the use of land or structures within such districts and by the establishment of regulations <br />for the location of structures, their height, bulk, percentage of lot occupancy and the area of open <br />spaces around any structure. <br />(Ord. 90-125. Passed 5-21-91.) <br />1113.04 SUPPLEMENT TO OTHER LAWS AND ORDINANCES. <br />The provisions of the Zoning Code shall supplement any and all laws of the State, <br />ordinances of this City or any and all rules and regulations promulgated by authority of such law <br />or ordinance relating to the purpose and scope of this Code. <br />(Ord. 90-125. Passed 5-21-91.) <br />1113.05 INTERPRETATION UPON CONFLICT. <br />In interpreting and applying the provisions of the Zoning Code, such provisions shall be <br />held to be the minimum requirements for the promotion of public peace, health, safety and general <br />welfare. Except as specifically provided herein, it is not intended by this Code to repeal, abrogate <br />or annul any existing provisions of any law or ordinance or any rule or regulation previously <br />adopted or issued pursuant to law relating to the construction and use of structures and land; nor <br />is it intended by this Code to interfere with, abrogate or annul any private easement, covenant, <br />agreement or restriction; provided where this Code imposes greater restrictions upon size or <br />location of buildings or use of the premises or requires larger or smaller lots, yards or other open <br />spaces, than are otherwise required or imposed, the provisions of this Code shall control. In other <br />cases of conflict between the provisions of this Code and any law, ordinance, rule, regulation, <br />easement, covenant, agreement or restriction the more restrictive shall govern. <br />(Ord. 90-125. Passed 5-21-91.) <br />~' 1113.06 SEVERABILITY. <br />~ Each section of the Zoning Code and each part of such section are declared to be <br />independent sections and parts of sections, and notwithstanding any other evidence of legislative <br />intent, it is hereby declared to be the controlling legislative intent that if any provision of such <br />sections, or the application thereof to any person or circumstance, is held invalid for any reason, <br />the remaining sections or parts of sections and the application of such provision to any person or <br />circumstances other than as to those to which it is held invalid, shall not be affected thereby, and it <br />is hereby declared that the Code would have been passed independently of section, sections or <br />,~, parts of a section held to be invalid. <br />(Ord. 90-125.
