Council Minutes of 5!4/2004 <br />offensive odors or unsanitary conditions that create a nuisance injurious to the health, <br />safety and public welfare. It was pointed out by the Law Director that just having <br />offensive odors does not rise to the level that would authorize our Animal Warden to <br />cite someone. Those odors must be strong enough to cause a risk to the health, safety <br />or public welfaze. With that wise counsel, the Animal Warden felt comfortable that <br />he was not going to be put in the position of perhaps battling neighbors or situations <br />wherein he would be asked to be Solomon in resolving these kinds of issues. Rather, <br />he could partner with the County Health Dept. in addressing the issues as to noxious <br />odors. Police Officer Holly indicated that the department has an enforcement issue <br />that sometimes becomes blurred because the code uses the word "frequently" leaving <br />animal waste behind. Yet, the definition of frequently can be very hard to enforce <br />and define. It puts the police in an awkwazd situation, and they can be drawn into <br />neighborhood battles. It was agreed that at this time the committee would <br />recommend passage of Ordinance 2004-53 but will look into the issue of use of the <br />word "frequently" in the code. <br />Councilman Miller, Council's representative to the Recreation Commission: 1) The <br />Recreation Commission met on Monday, April 5. Represematives from the hockey <br />organization were in attendance and asked that the commission begin looking at the <br />condition of the ice surface and rink boazds. The top rim of the rink needs to be replaced <br />with plastic. Right now it is wood, and it is presenting some dangers of injury to the <br />players because the wood tends to shed and break apart. Players' benches need to be <br />larger. The gate needs to be replaced. The scoreboard has been breaking down from <br />time to time, and they would like the bleachers replaced. <br />2) The Recreation Commission met on Monday, May 3. Ron Cook, representing NOSO, <br />and Safety Director Jesse reported that the BartonBradley watering project is going on <br />according to schedule. There has been cooperation, and Mr. Cook complimented the <br />Recreation Dept. for quick response in moving some soil to an area that had some ruts <br />due to the lazge amount of water. NOSO is going to be helping this yeaz with preparation <br />on Field 2. The commission discussed the We Caze program and supports the legislation <br />which is before Council this evening. The ordinance eliminates members of the boards <br />and commissions from participating in the We Caze program. The commission felt that <br />the We Care program is best designed for full-time, year-around employees as opposed to <br />members of boards/commissions, etc. The new game machines that were brought in are a <br />success, and it is anticipated that revenue received through June will exceed the total <br />revenue in 2003. The commission discussed Resolution 2004-74, which is the carrying <br />concealed weapons resolution, and the commission unanimously supports passage of <br />Resolution 2004-74. <br />Councilman Miller, chairperson of the Public Safety, Health & Welfaze Committee: 1) <br />The committee met on Tuesday, May 4, to discuss the transfer of a liquor license for the <br />new location of the VFW Post 7647. The Police Department had no objection to the <br />transfer. Councilman Miller made a motion that Council not object to the transfer of the <br />VFW Post 7647 liquor license from 27092 Lorain Road to 30036 Lorain Road.
