Council Minutes of 2/3/2004 <br />r President O'Grady recognized School Board members Don Frazier, JoAnn DiCarlo, Tom <br />Herbster, Superintendent Kurt Stanic, Treasurer Rob Matson, Assistant Superintendents <br />Doug Sebring and Cheryl Dubsky, principals and others and students who were in <br />attendance to recognize and congratulate Claire Hayes. <br />Law Director Dubelko: 1) On January 26, 27, 29, 30 and February 2, he attended labor <br />negotiating sessions or related management meetings. <br />2) On January 27 and February 3, he attended Board of Control meetings and directors' <br />meetings. <br />3) On January 22, he attended a meeting of the Fair Housing Review Board. <br />4) On January 25, he issued Legal Opinion 2004-1 which related to the subject of taxing <br />of lottery winnings. In summary: we don't; we can. <br />5) On January 26, he attended an organizational meeting of the city's Ethics Commission. <br />At that meeting, Finance Director Copfer was voted as the commission's chairperson. <br />6) On January 29, he distributed a contract procedure outline to all the city directors and <br />division heads to guide them when considering what procedures to follow when spending <br />the city's money or considering any proposed written contract. <br />7) On February 2, he prepared a draft of the BFI solid waste collection contract which has <br />been submitted to the Service Department. <br />Law Director Dubelko reported for Finance Director Copfer: 1) The Regional Income <br />Tax Agency sent out certain incorrect tax forms to taxpayers. On form 37A, the tax <br />credit and credit limit amounts were reversed. RITA has mailed letters to those taxpayers <br />receiving this form notifying them of the aforementioned error, referencing the tax table <br />which is correct in the instructions and providing RITA customer service telephone <br />numbers to answer any questions. The impact of this error should be minimal as the <br />majority of taxpayers file form 37EZ which allows RITA to compute their tax liability. <br />2) The financial books for the year 2003 are closed. End of the year reports are in <br />Council's mailboxes. The General Fund ended the year with $1,728,762. As has been <br />discussed at previous meetings, a combination of items created this carry-over. About <br />$700,000 is from revenues exceeding estimated resources and about $1 million is from <br />actual expenditures being less than appropriations. The Finance Director will be <br />providing a detailed review to Council at the next meeting. <br />3) The Finance Director met with the Mayor and the Safety and Service Directors this <br />weekend to review the submitted departmental budgets. They have begun compiling the <br />detailed budget information. She expects the administration to meet the 45-day provision <br />for the Mayor to present the appropriations to Council for its review. If it is completed <br />prior to that date, it will be sent to Council at that time. <br />4) The annual financial statement conversion and audit will begin field work next week. <br />5) RITA will be processing subpoena recipients for non-filing and non-payment of taxes <br />in Council Chambers from Monday, February 9, though Friday, February 13. <br />Councilman Nashar, chairperson of the Streets & Transportation Committee: 1) The <br />committee met on January 27. Present were committee members Dailey, McKay and <br />Nashar; Council members Miller, Gareau, Limpert; Mayor Musial, Fire Chief Klecan, <br />3 <br />
