Council Minutes of 11/1/2005 <br />called to review its own work. However, we are now under an EPA deadline. The <br />Service Director and the Mayor have contacted engineering firms, and we are limited in <br />the number of proposals received. It has been made very clear that this is potentially a <br />multi-phase situation, and under no circumstances would he accept the same company for <br />future phases. He understands the limits we are under at this time and is comfortable <br />with the decision. Mr. Dial said he recognized this issue had to move forward, but he <br />believed the concerns expressed by Mr. Gareau were long overdue to be brought out. <br />Bob Trapp, 5182 Porter Road, recently became aware of a Supreme Court decision <br />concerning the use of eminent domain by municipal governments. He would like this <br />issue to be brought up for future discussion by City Council to develop a policy on <br />eminent domain for the city. He lives near the Hallen/Kia development that will soon be <br />under construction, and he would like to have the city be prepared to deal with issues <br />where a private enterprise may decide that they want to purchase additional land and the <br />impact that would have on homeowners. (Mr. Trapp provided newspaper articles on this <br />issue for distribution to City Council.) Councilman Gareau said he had personally <br />represented residents in Lakewood who were fighting the use of eminent domain. In <br />North Olmsted, eminent domain has been used only for a public purpose. He agrees that <br />this is an important issue. <br />Mr. Bouman came forward and attempted to speak again. President Kennedy did not <br />recognize him for that purpose and explained he could speak at the next Council meeting. <br />Mr. Bouman did not accept the ruling and attempted to continue speaking. In response to <br />a question from Mr. Bouman, Law Director Dubelko explained that the Council President <br />runs the meeting; and, if someone did not abide by the rules, they could be escorted from <br />the room for disrupting a meeting. At this point, two police officers arrived and escorted <br />Mr. Bouman to his seat. <br />LEGISLATION <br />Resolution No. 2005-144 introduced by Mayor O'Grady and Council members Ryan and <br />Barker was given its third reading. A resolution authorizing and directing the Director of <br />Planning to make application on behalf of the City of North Olmsted for Community <br />Development Block Grant (CDBG) funds for the fiscal year 2006 for the HUD/Cuyahoga <br />County Exterior Maintenance Program, and declaring an emergency. Councilman Ryan <br />moved for adoption. The motion was seconded by Councilman Nashar and passed <br />unanimously. Resolution No. 2005-144 adopted. <br />Resolution No. 2005-145 introduced by Mayor O'Grady and Council members Ryan and <br />Barker was given its third reading. A resolution authorizing and directing the Director of <br />Planning to make application on behalf of the City of North Olmsted for Community <br />Development Block Grant (CDBG) funds for the fiscal year 2006 for handicapped <br />accessibility improvements to the North Olmsted Park, and declaring an emergency. <br />Councilman Ryan moved for adoption, and the motion was seconded by Councilman <br />Barker.
