~s <br />Council Minutes 4/5/2005 <br />would be restaurant full service; the second would be restaurant fast food; the third <br />would be restaurant limited service. The crux of the whole ordinance was defining <br />these very small sandwich-shop type operations-ice cream stores, etc.-which <br />would now be defined as a fast food restaurant that does not fry, broil or griddle any <br />of its menu items on site and whose gross floor area does not exceed 2,500 squaze <br />feet and does not have adrive-through facility. Those three definitions of full service, <br />fast food and limited service were included. Also an amendment in 1139.06 includes <br />restaurant free standing, restaurant full service and restaurant fast food. It does not <br />include restaurant limited services as those terms aze defined in 1115.02 of the <br />Zoning Code. This issue has arisen on several sites where a developer wishes to open <br />a small restaurant, and they have been precluded on at least two occasions from our <br />Zoning Code definitions which the Planning Director thought were a little too <br />restrictive. A public hearing on this legislation was held. It has been discussed in <br />committee more than once. Following discussion, the committee unanimously <br />recommended approval. <br />AUDIENCE PARTICIPATION <br />Dennis Lambert, 25057 Carey Lane, spoke on the following issues: <br />He is seriously concerned about the condition of bridges, especially the bridge over <br />I-480 on Great Northern Blvd, which is filled with large chunks of concrete and <br />curbing big enough to do severe damage and cause physical harm to anybody driving <br />below should someone drop one of those pieces off the bridge. He walks most of the <br />bridges and they are extremely filled with gravel and dirt. Besides being a hazard to <br />pedestrians, they are a detriment to the city's budget because gravel, dirt and broken <br />glass act as abrasives causing erosion of the surface of the street. By putting a few <br />dollars into clean-up work, the city may save money on future slab repair. He is also <br />concerned about heavy trucks causing damage on Rt. 252. <br />Welcome to new Mayor whom he believes will take on the challenge and be <br />successful. He likes the methodic approach to operation of the administration and <br />appreciates that the Mayor is taking time to analyze and not taking everything as a <br />given or in concrete from the past. Somewhere in his heart he feels the spirit of the <br />Mayor's father is smiling as the Mayor took the torch and moved on a little bit further. <br />Councilman Nashar commented, with regard to the bridge over Great Northern Blvd., <br />that had been addressed recently and it will be addressed in committee soon to discuss <br />funding for the work. Service Director Driscoll has had people out there on numerous <br />occasions cleaning up the azea and also Stearns Road. Mayor O'Grady thanked Mr. <br />Lambert for his comments. Regarding the bridge on Rt. 252, not only is there potential <br />for that damage and costing city money, but also costing money because ODOT has <br />decided the damage on the overpass was so bad it needs to be completely redone and they <br />expect the city to pay the entire cost. However, ODOT built that overpass and ODOT, if <br />they made errors with the design and the content of the cement, contributed to the <br />problem probably in its entirety and now they are walking away from the city when we <br />need their help.
