Council Minutes of 10/3/2006 <br />;„t,,,, Orlowski and Miller; Council Members Barker, Dailey Jones, Tallon, and President Kennedy; <br />,;w, Planning Director Wenger, Law Director Dubelko. Legislation for review included 2006-122, <br />2006-130, and 2006-135. Originally, Taco Bell was on as a referral from Planning & Design, <br />but that was tabled. Also, a potential presentation from Fifth Third Bank did not go forward. <br />Items that went forward were H & M Clothiers and Exit 2 Storage. As he had previously <br />indicated he would abstain from consideration, deliberation or vote on any matter concerning <br />Exit 2 Storage based upon his relationship as an attorney with Mr. Schmidt and his corporation, <br />committee member Councilman Miller presided over the portion of the meeting dealing with <br />Exit 2 Storage. He requested Mr. Miller give the report on Exit 2 Storage. <br />Councilman Miller, member of the BZD Committee: 1) Individuals. present included those <br />mentioned by Mr. Gateau and the developer Mr. Schmidt and his attorney Ron Mills. Exit 2 <br />Storage is located at 31399 Industrial Parkway. The applicant was successful in obtaining a <br />variance from the Board of Building Cade Appeals for outdoor storage in the side yard. <br />Therefore, the applicant has amended the proposal to include a canopy over the storage azea, <br />which would satisfy the conditions of the Building Code. Discussion was had primarily <br />involving landscaping. Because the time between the Planning & Design Commission meeting <br />and the committee meeting was very short, they were unable to present the landscaping plan. <br />However, they did agree to follow the recommendations of the Plarnung & Design Commission, <br />which includes enhanced landscaping in the front area of their property as well as a row of trees <br />to the rear of the property-evergreens minimum 8 foot spaced approximately 20 feet apart. The <br />committee recommended approval of Exit 2 Storage with two conditions: (1) The landscaping <br />plan be submitted with review by the City Forester to assure that it follows all the <br />recommendations of the various boards and commissions; (2) The Fire Dept. review the plans <br />and approve them. Councilman Miller made a motion to approve the plans for Exit 2 Storage as <br />amended. The motion was seconded by Councilman Tallon and passed unanimously. <br />Councilman Gateau continued with the BZD Committee report: <br />• Ordinance 2006-122, an ordinance amending Section 1139.01 of the Zoning Code in <br />order to eliminate the locatianal and density requirements for pet stores and animal <br />hospitals in General Retail Business Districts. This matter was held over from a previous <br />committee meeting, and it was again held in committee. A full report will be given at <br />such time as the committee refers the matter to City Council. <br />• Ordinance 2006-135, an ordinance creating new Chapter 1142, Residential Office <br />District, of the North Olmsted Zoning Code in order to establish a new district of <br />permitted uses as amended. Most people are familiar with this legislation as that which <br />was crafted to address zoning issues in the far western area of North Olmsted, in essence, <br />the Bradley Road property which is presently zoned Light Industrial. This ordinance <br />does not rezone anyone's property, it simply creates a zoning district which could be <br />applied to property through separate legislative mechanism. The legislation came to be <br />as a result of work through the Law Dept. and the Planning Dept. as well as the input <br />from the zoning steering committee which involves several individuals including a <br />representative of Planning & Design as well as Councilmen Tallon and Gateau. P & D <br />members Ralph Bohlmann and Melissa Meredith also serve on that committee. The <br />steering committee felt they devised and recommended to the administration a good, <br />appropriate use for that particular neighborhood if it is applied.
