Council Minutes of 9/5/2006 <br />the sale of the old fire station and that should replace some of the money spent to bring <br />this building into compliance for the benefit of all residents of North Olmsted. It was <br />stated that we would have money from the fire station, but. also land in the industrial park <br />along with land purchased through CDBG funds. In a couple of yeazs, we'll be able to <br />sell that property. It is the feeling that those funds should be directed into the fund from <br />which the improvement money is coming. The Mayor smoke passionately regarding the <br />plan that was approved by Council and then voted down in the transfer ordinance. He <br />asked for support on the transfer ordinance tonight to appropriate $116,200 to complete <br />the original project. If the transfer ordinance is passed tonight, the feeling is the project <br />could be done by the end of the yeaz. A motion by Mr. Gareau from the Recreation <br />Committee was made to recommend Resolution 2006-147. The motion was seconded by <br />Mr. Orlowski from the Safety Committee and failed by a vote of 4-1. <br />Councilman Orlowski, chairperson of the Public Safety, Health & Welfare Committee: <br />1) The committee meeting was called to order on August 22, 2006.. In attendance were <br />members Tallon, Barker and Orlowski; Council Members; Mayor, Assistant Law <br />Director, Safety Director, Chamber of Commerce rep Jim Burns and guests. Agenda <br />items were as follows: <br />• Ordinance 2006-146, which refers to Section 741.03 of Chapter 741 of the <br />Business Regulation Code of the City of North Olmsted. This is a minor change <br />which shall establish the hours of prohibition of commercial deliveries to be <br />consistent with the hours found in Section 555.03 of the Noise Control Code. Mr. <br />Burns, Chamber of Commerce rep, gave a good account off' previous discussions <br />and history on Chapters 741 and 555. Mr. Burns spoke on the associated problem <br />with a noise ordinance and a business ordinance affecting business owners within <br />a city. He would like to reconsider changes to the two ordinances and the <br />possibility of combining the two ordinances in one section of the Codified. <br />Assistant Law Director O'Malley requested the committee to address only <br />Ordinance 2006-146 as a minor time change from 7 a.m. to 7:30 a.m. so there <br />would be less confusion and possible problems in enforcement of the noise and <br />delivery sections of the code. Mr. Burns believed the 7 a.m. time should remain <br />as it allows time for a truck to be spotted on a truck dock and then begin <br />unloading at 7:30 a.m. as it is under current ordinances. Mr. Burns believes the <br />city should provide information on our ordinances regazding truck delivery times, <br />truck unloading times, etc. to the trucking firms so they are aware of what we <br />require of them. Mr. Orlowski concurs with the theme of his idea, but believe it is <br />up to the business community to provide their delivery/logistics companies with a <br />copy of city ordinances. <br />2) Ordinance 2005-158 was briefly discussed. <br />3) Mr. Barker requested Ordinance 2006-70 be recommended for tabling. This ordinance <br />dealt with the temporary closing of Esther Ave. at the Fairview Park corporation line to <br />through traffic during the reconstruction of Clague Road. The committee voted <br />unanimously to recommend tabling of Ordinance 2006-70. <br />4) The committee voted unanimously to recommend adoption of Ordinance 2006-146 <br />under suspension of the rule. <br />6 <br />
