Council Minutes of 4/18/2006 <br />2) Councilman Ryan made a motion to amend Council Rule 62, Amendment of Rules, <br />by replacing the word "committee" to "Infra-Governmental Relations Committee" and <br />removing the words "for such purpose." The motion was seconded by Councilman <br />Orlowski and passed unanimously. Council Rule No. 62 amended. <br />Councilman Orlowski, chairperson of the Public Safety, Health & Welfare Committee: <br />1) The committee met on April 11, 2006. In attendance were committee members <br />Orlowski, Tallon, Barker; the Law Director, Safety Director, Council Members and <br />guests. Addressed was Ordinance 2006-56. A map developed by the Fire Department <br />and the Building Department was discussed. This map was developed to give <br />information regarding several distances from a private or public elementary or secondary <br />school, library or daycare center. The map is being used as a guide to indicate the overall <br />impact of the distances in regards to locations within the city where certain sex offenders <br />may be allowed to reside. We do not wish to create a single small section of the city <br />where certain sex offenders may be required to live. The distances originally considered <br />were 1,000 feet, 1,500 feet and 2,000 feet. Also, originally considered was the distances <br />figured from property lines. Due to the logistical problems of the distances emanating <br />from all edges of the property lines, it was decided to figure all distances from the actual <br />building on the site. After discussion, it was also decided to use a distance of 1,~0 feet <br />which would conform with state code. The Law Director concurred with these decisions. <br />This will require amending the ordinance as originally written. Also discussed was the <br />possibility of different distances from the buildings in regards to the location of the <br />building in residential neighborhoods as versus a building located on a commercaUretail <br />street. The committee decided that a uniform distance from buildings in any location <br />would be a more appropriate implementation of this ordinance. The committee decided <br />to hold Ordinance 2006-56 in committee to allow the Law Director additional time to <br />research the imposition of criminal penalties, which this ordinance imposes on certain sex <br />offenders regarding where they can reside. The State of Ohio code does not impose any <br />criminal penalty for non-compliance with certain requirements for certain sex offenders. <br />2) Ordinance 2005-158 was held in committee. The Chamber of Commerce <br />representative was unable to attend the meeting. <br />Councilman Gareau commented that he had asked Mr. Tallon to take into the Finance <br />Committee the issue of the substantial sum of money that remains in the library <br />borrowing, possible in excess of $500,000. He would like to have input from the <br />administration and the art consultant as to what has been purchased. He would like to see <br />the money used to provide services at the library, especially for what it offers pre-school <br />children. Our library is somewhat wanting in that area compared to other libraries. This <br />would be a substantial step toward improving a building that was built to service the <br />entire community. Councilman Tallon said he agreed with Mr. Gazeau wholeheartedly, <br />and the committee will look into the bonding to see what we aze allowed to do with that <br />money.
