Council Minutes of 4/4/06 <br />recommendation of the Planning Commission pursuant to the powers set forth in Article <br />VII, Section 2 of the N. O. Charter. Resident Janet Dorn addressed a question to the <br />committee regarding the name of the applicant and whether it changed throughout the <br />course of these proceedings. Ms. Wenger explained to the committee's satisfaction that <br />the name of the developer had not changed and had remained constant throughout the <br />entire procedure. Mr. Dubelko added additional comments concerning the voting <br />procedure. At that point, there was no further audience participation, no further <br />comments were provided by Mr. Rinker or any other member from the applicant <br />company. At the committee meeting, chairperson Gareau made a motion to recommend <br />approval of the site plan, and the motion was seconded by Councilman Miller. A roll call <br />vote ensured with Mr. Orlowski voting no, Mr. Miller voting no and Mr. Gareau voting <br />no. The committee did not recommend approval. Cauncihnan Gareau made a motion <br />that Council approve the Shadow Wood sii7gle family cluster on Bradley Road, and the <br />motion was seconded by Councilman Miller. Roll call: Gareau, no; Miller, no; Jones, <br />no, with comment. Approval of this project is not the right zoning tool for this area. The <br />project significantly changes this neighborhood. She is against a piecemeal approach to <br />rezoning the area of BartonBradley in Ward III. Roll call continued: Barker, no; Tailon, <br />no; Ryan, no; Orlowski, no. The motion failed with seven no votes. <br />• Sprint/Victoria Plaza. This proposal consists of the installation of wireless <br />telecommunications antennas on the rooftop of the Victoria Plaza on Country <br />Club Boulevard, 26101 Country Club. The city's Zoning Code requires the <br />applicant to obtain a conditional use permit as the antenna would be a conditional <br />accessory use. It exceeds the permitted number of antennae as well as the <br />permitted height limit for the antenna. Sprint was represented by Ms. Courtney <br />Schmidt. She r~uested to install six antennas on the existing rooftop of the <br />Victoria Plaza. The height of the antennas will be approximately 9 '/Z feet tall <br />with fiberglass screening material that will match the color and will appear to <br />have a textured appearance similar to the existing penthouse. It was noted that the <br />machinery cabinets will be located in the center of the roof with shielding <br />material around them as well. Following a discussion concerning the location of <br />the structure and the visibility of the antennae from the ground, a motion to <br />approve the proposal and conditional use permit subject to the recommendations <br />of various boards and commissions was made and the committee unanimously <br />approved. Councilman Gareau made a motion that Council approve the <br />Sprint/Victoria Plaza proposal to install antennas on the roof top of Victoria <br />Plaza, 26101 Country Club Boulevard and to grant the conditional use permit. <br />The motion was seconded by Councilman Miller and passed unanimously. <br />• Ordinance 2005-95, an ordinance amending various sections of Chapter 1238 <br />(Senior Residence District) of the North Olmsted Zoning Code in order to clarify <br />and update development regulations for the Senior Residence District as twice <br />amended. This matter was reported out at a previous special Council meeting and <br />amended at that time. Changes have been made to the :substantive text of the <br />document. However, there appears to be anon-substantive typographical error in <br />the second Whereas clause, No. 4 indicates that this legislation would create a <br />8 <br />
