Special Council Minutes of 3/30/06 <br />that there could be no more than three single family cluster units that may be attached in <br />any building grouping. Mr. Dubellco and Ms. Wenger felt that would be sufficient to tie <br />into other development standards within the community and would at least get us beyond <br />the potential of a claim that we were violating people's federal law rights. The second <br />area was Section 1138.08 regarding dwelling unit size. Multiple family residences will <br />now be governed by independent living units which will be 450 net square feet; assisted <br />living units shall be governed by the regulations set forth in Chapter 3701.17 of the <br />Administrative Code. With respect to residential nursing homes, they will continue to be <br />governed also by Chapter 3701.17. Councilman Gareau made a motion to amend <br />Ordinance 2005-95 consistent with the changes set forth in the version attached as <br />Exhibit B to the legislation. The motion was seconded by Councilman Miller and passed <br />unanimously. Councilman Gareau thanked his colleagues for the support of these <br />amendments. It may not be the perfect solution to the current arrangement, but it is better <br />than we currently have. We will continue to look at these types of things. Thanks to the <br />Law Director as he worked very diligently on this issue. <br />LEGISLATION <br />Ordinance No. 2005-95 introduced by Mayor O'Grady was given its second reading. An <br />ordinance amending various sections of Chapter 1138 (Senior Residence District) of the North <br />Olmsted Zoning Code in order to clarify and update development regulations for the Senior <br />Residence District as twice amended. <br />EXCUSE FOR~SENCE <br />Councilman Miller made a motion to excuse the absence of Councilman Talton. The motion was <br />seconded by Councilman Ryan and passed unanimously. <br />With the agenda being completed, President Kennedy adjourned the special meeting at 7:25 p.m. <br />L <br />L.
