Council Minutes of 12/18/2007 <br />telecommunications industry, from the public. The administration has weighed in, the <br />City Engineer has weighed in, and outside counsel. We have crafted very good <br />legislation that allows the city, as the gentleman from AT& T stated, to exercise our right <br />to reasonably regulate our right-of--way areas; but, at the same time, allows all the utility <br />companies and all the telecommunication providers to come in and use the right-of--way <br />subject to reasonable regulations. He suspects in 2008 we'll see AT&T come into the <br />city to provide the service. He noted that one of the things that North Olmsted over the <br />years has been a little bit unique over other communities is that we've had two cable <br />providers for years. We were in a little bit of a better competitive environment because <br />of that. This will just make it better. This not anti-U-verse legislation. It really has <br />nothing to do with it. He is hopeful that AT&T will come to the city in 2008 and provide <br />the service. <br />3) Doug Hogan, Illuminating Company, 6896 Miller Road, 44141, said they are not <br />putting in a cable system. The city has a letter from their attorney, who represents their <br />company and the gas company, outlining problems they have with the ordinance. They <br />are still going to provide service to their customers in the best way they can possibly do <br />it. The ordinance just makes it harder to do that. <br />4) Steve Grasso, 25791 Tallwood Drive, works for AT&T, and has been reading about <br />this ordinance which he thinks is going to put roadblocks to getting U-verse to North <br />Olmsted. We do have two cable companies in North Olmsted who keep on raising their <br />rates and are bleeding AT&T by offering voice-over IP and taking away their dial tone. <br />U-verse is one way for AT&T to come back and get in the game and regain that dial tone. <br />They are losing customers to the cable companies and have no way to compete with them <br />without the bundle with U-verse. He also gets calls and questions from friends <br />throughout North Olmsted asking whether they can get DSL or U-verse. This is just <br />going to make it harder to get their boxes in here. Every other city around Cleveland is <br />getting this. He is concerned to know North Olmsted has these roadblocks with this <br />ordinance and the potential of lawsuits from the gas and electric company. <br />LEGISLATION <br />Ordinance No. 2007-82 introduced by Mayor O'Grady was given its second reading for <br />tabling. An ordinance amending Section 755.11 of Chapter 755 (Secondhand Dealers) of <br />the Business Regulation Code, entitled "Hours and Circumstances of Sales," in order to <br />regulate outdoor collection receptacles on commercial property, and declaring an <br />emergency. Councilman Orlowski moved to table. The motion was seconded by <br />Councilman Ryan and passed unanimously. Ordinance No. 2007-82 tabled. <br />Ordinance No. 2007-124 introduced by Mayor O'Grady was given its second reading. <br />An ordinance to adopt a new Chapter 902, entitled "Use of Public Right-of--Way by <br />Service Providers and Contractors Performing Work on Service Provider Facilities," and <br />declaring an emergency, as amended. Councilman Gareau moved for suspension of the <br />rule requiring three readings and noted the legislation had been reviewed in committee. <br />The motion was seconded by Council Member Jones.
