Council Minutes of 8/21/2007 <br />9) Assistant Law Director Carole Heyward has spent some time preparing two important <br />pieces of legislation: the Job Creation Grant Program legislation, and the corrections <br />facilities legislation that has been sponsored by several members of Council. She did a <br />lot of good work on both of those. She is still working on putting together her real <br />property maintenance initiative to present to the administration and, if necessary for <br />Council action, to City Council. She is also working with Council Member Jones on fair <br />housing matters preparing for Homecoming. <br />10) Civil litigation-Elm Street litigation continues on. We did have some meetings <br />earlier in the year in an effort to attempt to settle the litigation by having the developer <br />submit a new proposal that would meet the city's new cluster development code, but we <br />never did hear back from the developer. A pre-trial was held the other day, and the court <br />has set some discovery and other deadlines. We are marching forward on the litigation, <br />and he feels pretty comfortable in that litigation. <br />11) He has taken back into the administration the "Do Not Knock" pending legislation. <br />He sent it off to the Safety Director on the input of administrative costs. He prepared <br />changes in the legislation in his department and hopes to get that back to Council shortly. <br />Councilman Gareau asked if the city has received feedback on the right-of--way <br />telecommunications box issue that was sent over to Walter & Haverfield. Law Director <br />Dubelko answered that the box location issue was part of the negotiations if we were <br />going to enter into a franchise agreement with AT&T. In the meantime, S$17 was <br />passed and then AT&T withdrew from the negotiations. <br />Finance Director Copfer: She participated in a police union negotiation session on <br />August 9, 2007. <br />2) Two of the finance staff attended a Munis Ohio users meeting in Strongsville on <br />August 9, 2007. There are some large potential Ohio government agencies looking at <br />bringing Munis on as their financial system. All the cities that were there had an <br />opportunity to complain that they need more support, upgrade and hardware staff at <br />Munis before Munis should grow any more. This is an acknowledged issue by the Munis <br />representative. On the bright side, the additional clients in Ohio may make us more <br />powerful when attempting to affect change. The budget preparation module was also <br />previewed at this meeting. <br />3) She attended a meeting with the Mayor, Service Director, ATS consultants and <br />WWTP management to discuss the rate and operations plan and the presentation the <br />consultants are to prepare for Council. This is different than the EPA Phase II study that <br />was mentioned previously that is by CT Consultants. <br />4) She participated in a negotiation session with the AFSCME service union on August <br />16, 2007. <br />5) She participated in the fifth and final day of fact finding with the fire union on August <br />20, 2007. Both attorneys are going to submit briefs by September 24, 2007 and then the <br />fact finder will begin writing his report. <br />6) She attended a Recreation Plan meeting today to discuss various issues and a potential <br />timetable to bring this to fruition. <br />7) On a personal note, her parents, Bruce and Rita Weir celebrated their 50`" wedding <br />anniversary on August 10, 2007.
