<br />NORTH OLMSTED CITY COUNCIL <br />MINUTES OF THE PUBLIC HEARING <br />APRIL 3, 2007 <br />Present: President of Council Kennedy, Council Members Barker, Gareau, <br />Dailey Jones, Miller, Orlowski, Tallon <br />Also Present: Clerk of Council Seman <br />President of Council Kennedy call8d the public hearing to order at 7 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />President Kennedy announced the public hearing was being held with regard to <br />Ordinance No. 2007-20, an ordinance amending Section 1126.11 (Deviations From <br />Approved Plans Prohibited) of Chapter 1126 of the North Olmsted Zoning Code in order <br />to require that developers certify that site development plans and building elevations <br />submitted to the city Building or Engineering Departments incorporate ail requirements <br />of the final development plan approved by City Council. <br />AUDIENCE PARTICIPAT,~ON <br />James Burns, Chamber of Commerce representative, 25045 Lorain Road, said the <br />ordinance does not address the real problem, and that is whatever confusion there may be <br />between the city and the developer on what was actually required by Planning & Design <br />Commission and by City Council. The discussions can get confusing, and it is sometimes <br />difficult for Council members and the developer to determine what was actually agreed <br />upon, especially months or years later. He suggested the ordinance needs to require a <br />written document that can be signed off on by the Building Department and the developer <br />where they agree to what was required by Planning & Design Commission and by City <br />Council with respect to the final development plans.
