NORTH OLMSTED CITY COUNCIL
MINUTES OF THE PUBLIC HEARING
APRIL 3, 2007
Present: President of Council Kennedy, Council Members Barker, Gareau,
Dailey Jones, Miller, Orlowski, Tallon
Also Present: Clerk of Council Seman
President of Council Kennedy call8d the public hearing to order at 7 p.m. in Council
Chambers, 5200 Dover Center Road, North Olmsted, Ohio.
President Kennedy announced the public hearing was being held with regard to
Ordinance No. 2007-20, an ordinance amending Section 1126.11 (Deviations From
Approved Plans Prohibited) of Chapter 1126 of the North Olmsted Zoning Code in order
to require that developers certify that site development plans and building elevations
submitted to the city Building or Engineering Departments incorporate ail requirements
of the final development plan approved by City Council.
AUDIENCE PARTICIPAT,~ON
James Burns, Chamber of Commerce representative, 25045 Lorain Road, said the
ordinance does not address the real problem, and that is whatever confusion there may be
between the city and the developer on what was actually required by Planning & Design
Commission and by City Council. The discussions can get confusing, and it is sometimes
difficult for Council members and the developer to determine what was actually agreed
upon, especially months or years later. He suggested the ordinance needs to require a
written document that can be signed off on by the Building Department and the developer
where they agree to what was required by Planning & Design Commission and by City
Council with respect to the final development plans. It's best to have it in writing.
With there being no further comments, President Kennedy adjourned the public hearing
at 7:05 p.m.
`' `-- ''h
arbara L.
