City Council Minutes of 4/3/2007 <br />Planning and Design Commission, the Law Department, the Building Department or the <br />Building, Zoning & Development Committee. The law requires one to take <br />consequences for their own acts. He would say there was less of the project that was <br />approved that was actually constructed than there was that was changed. Colors, building <br />materials, scale and landscaping-all of it was changed. Little of it looked like what Mr. <br />Jai Wei indicated it would look like. Even in discussion, Mr. Jai Wei indicated that, <br />while he presented original plans with gooseneck lamps, he never had any intention of <br />actually installing them as presented. His frustration has to do with the idea that one <br />could just take up the time of the boards and commissions and then do whatever one <br />chooses and then be upset when the board seeks to enforce its rights and the city's rights <br />against it. Everybody in the room had their chance to explain to him how they felt, and <br />they did. Mr. Kurt Reddick of Great Northern Mall agreed with the project as built, not <br />as designed and expressed his satisfaction with it. The project, despite the changes, <br />presented an attractive appearance to the community. The committee recommended as <br />follows: <br />1. Westfield Corporation will submit a comprehensive landscaping plan for the <br />north facade of the mall within 60 days. <br />2. The changes found acceptable included the different base material, different <br />height of the base, different door, different door and window framing, different <br />column material, and the removal of the bird wire. <br />3. The proposed revised lighting fixture is an acceptable fixture to be placed over <br />the six awnings. Mr. Jai Wei changed it to a canister-type light which was <br />presented to be in antique bronze. The BZD Committee and the Planning & <br />Design Commission both recommended that would be changed to a mirror finish. <br />It should be noted that Mr. Jai Wei already indicated that he's having a hard time <br />find these lights. But it should be perfectly clear that the lights as presented on <br />the plans were approved to be in a mirror finish and not in the bronze antique <br />finish that was presented. The Planning & Design Commission recommended the <br />lighting will not exceed 90 watts, each both up and down and is found to be <br />decorative lighting therefore not requiring any variance. The BZD Committee <br />agreed. The three light fixtures which are installed within the archway are <br />recommended to be replaced with three mini spot fixtures. <br />4. The color of the building which was the main issue will remain the same. <br />There is no requirement to paint the building. <br />Councilman Gareau made a motion to approve Wild Mango consistent with the <br />recommendations of the BZD Committee and the Planning & Design Commission with <br />the exception of the color change. The motion was seconded by Councilman Orlowski <br />and passed unanimously. <br />Ordinance 2007-5, an ordinance amending Chapter 1136, Single Family Cluster District, <br />of the Zoning Code in order to establish new regulations for Single Family Cluster <br />5 <br />
