City Council Minutes of 4/3/2007 <br /> <br />project. If it is not done by April 15, the federal funding goes away, and they will have to <br />wait until next year. When completed, the project will add about 180 spaces to the <br />approximate 305 parking spaces currently there. This is not a final approval of the plan; <br />it is simply removing some trees and preserving the trees that are represented on the plan <br />dated March 22. Councilman Gareau made a motion to approve the tree removal for <br />Greater Cleveland RTA Park-n-Ride expansion consistent with and as noted on the plan <br />dated March 22, 2007 and presented to the Building Department. The motion was <br />seconded by Councilman Miller and passed unanimously. Councilman Gareau noted that <br />the bats may not actually live in the trees, but because it is federal funding, we have to <br />assume they might. It is an extraordinarily unusual procedure to approve a component of <br />a plan. Under these limited circumstances, he thanks Council for its indulgence. <br />Councilman Tallon, chairperson of the Finance Committee: 1) He previously reported at <br />the special meeting of Council on March 27, 2007 regarding the Finance Committee <br />discussion of Ordinance 2007-29, which is on this evening's agenda. The committee <br />recommended approval and passage under suspension of the rules by a vote of 2-1. <br />Councilman Barker requested a moment of personal privilege. He thanked Council for <br />excusing his absence from the previous Council meeting as that was the day his <br />granddaughter was born. Thanks to all who sent messages of congratulations. Mother, <br />father and baby are doing just fine. <br />Council Member Dailey Jones, chairperson of the Streets anal Transportation. Committee: <br />1) The committee met on Tuesday, March 27, 2007. Present were Committee Members <br />Barker and Jones; Council Members Gareau and Orlowski.; Council President Kennedy; <br />Mayor O'Grady. The committee met regarding Ordinance 2007-27, establishing new <br />regulations relating to the removal and deposit of snow and ice on sidewalks, tree lawn <br />areas, and driveway aprons in the City of North. Olmsted; creating new Section 765.02 of <br />the Business Regulation Code; amending Sections 521.06 and 521.11. of the General <br />Offenses Code; and declaring an emergency. Mrs. Janes stated that the Law Director and <br />Service Director could not attend the meeting; however, the Committee wanted to give <br />the Chamber of Commerce and others an opportunity to weigh in on this subject. Mr. <br />Burns, Chamber of Commerce representative, stated that the Chamber has concerns about <br />the "trickle down" effect of forcing businesses to remove snow from their sidewalks. If' a <br />business were to be sued by a pedestrian who falls on a sidewalk that has been. cleared, <br />the city could potentially be liable as well. For example, the business could say that the <br />city made them clear the walk so the city is ultimately responsible. The Chamber <br />welcomes the opportunity to continue dialogue on this issue. A resident in attendance <br />said she has a few concerns regarding this issue, especially that the city would not <br />continue to have an ordinance that would have residential property owners clear their <br />walks. Her concern is for the children who are forced into the street when. walking to <br />school or the bus stops. The Law Department has asked for additional time to work on <br />this issue as has the committee. The committee voted 2-0 to hold the legislation in <br />committee. <br />2) April is Fair Housing Month. Information is available at the North Olmsted Library <br />regarding fair housing and the Fair Housing Review Board. <br />7 <br />
