Council Minutes of 2/7/2007 <br /> <br />Councilman Gareau, chairperson of the Building, Zoning & Development Committee: 1) <br />The BZD committee met on Tuesday, January 30, 2007. Present were committee <br />members Gareau, Orlowski and Miller, Council members Barker, Jones, Council <br />President Kennedy, Director of Law Dubelko, Planning Director Wenger and Service <br />Director Limpert. Agenda items: <br />• North Olmsted Laser Wash, 25054 Lorain Raad, with an amendment to the <br />approved landscape plan which had been approved by City Council in 2006. The <br />Planning Director advised that there were two modifications: a landscape <br />amendment for the island adjacent to the building and a change to plantings <br />around the monument sign near Lorain Road. The request for a minor change <br />was denied, at least once perhaps twice. In support of the proposal, the applicant <br />advised that the bed adjacent to the building could not withstand (1) the overspray <br />from the building exit of cars; (2) the prevailing winds; (3) a traffic circulation <br />problem; (4) as presented by a previous individual, it was removed at the behest <br />of the Engineering Department. The committee discussed the legitimacy of the <br />reasons for the change and further expressed that it was growing weary of <br />developers who obtain approval from the approval process, then construct the <br />building, and then immediately seek modifications to the plan. The Planning <br />Director advised that she was in agreement with the monument sign change <br />(burning bushes on the north and south side of monument sign, extending the <br />beds, adding low growing perennials in addition to the juniper bushes to offer <br />seasonal color) but disagreed with the removal of the bed to the east of the exit <br />door. Mr. Orlowski brought to the attention of the committee the need for a tree <br />count to the north of the lot given a discrepancy on plans submitted in the number <br />of trees planted versus the number of trees that were originally approved. The <br />committee recommend by a vote of 3-0 the changes to the landscaping at the <br />monument sign, but voted 3-0 to reject the changes at the landscaping bed along <br />the building. The cornrnittee further required verification of the site plan to <br />confirm the appropriate tree plantings. Subsequent to this meeting, he received a <br />call from owner of the car wash who was not present for the actual proposal and <br />discussion. He was aware of what took place, and he asked to speak to the BZD <br />committee to discuss his concerns with not having the modification. He will <br />place that before the City Council to determine whether it wishes to send this <br />matter back to BZD for Mr. Ron Nelson to discuss it since it's not his decision to <br />make. Councilman Gareau made a motion to refer back to the BZD Committee <br />the North Olmsted Laser Wash, 25054 Lorain Road, with an amendment to the <br />approved landscape plan. The motion was seconded by Councilman Ryan. <br />Councilman Miller asked a procedural question of the Law Director is a non- <br />committee member could second the motion? The Law Director said yes. Roll <br />call: Gareau, yes; Ryan, yes, worried, but will vote yes. Roll call continued: <br />Miller, no, commenting he would certainly welcome a letter from the owner but at <br />this point he thinks enough time has been spent on the issue. Roll call continued: <br />Orlowski, yes; Tallon, yes; Barker, yes; Jones, yes. The motion passed with six <br />yes votes and one no vote.
