<br />Council Minutes of 1/2/2007 <br />2) He wishes all of Council well in 2007 and promises to continue to provide City <br />Council with the best legal advice and counsel he can. <br />Finance Director Copfer: 1) Hopes all had a Happy New Year. <br />2) October month-end financials were distributed December 5. November's month-end <br />financials were distributed today. An overview of the General Fund reveals that revenue <br />is up nearly $800,000 over the prior year, which is about 4%. We are at }9.2% collection <br />of the estimated resources through November. Expenditures, while up 5.5%, after <br />backing out the pension accruals, are at about 85% of the annual plan. It looks like about <br />2% or 3% of the budget will be left over. Estimating based on November and also on <br />what she has seen so far in December, there probably will be a carry-over of about $1.2 <br />million to $1.6 million for the end of the year. The Finance Department is closing last <br />year and beginning work on this year. Everything is in compliance. This is the first year <br />that the department has actually been on one computer system with payroll, AP <br />purchasing and the general ledger for the entire year. All the detail will be there. She <br />thanks Council for the new system as it makes the work a lot easier. <br />Councilman Gareau, chairperson of the Building, Zoning & Development Committee: 1) <br />The committee met on Wednesday, December 20, 2006. Present were committee <br />members Gareau, Orlowski and Miller; Council Members Barker, Jones; City Planner <br />Kim Wenger. There were two agenda items: <br />• Ordinance 2006-122, an ordinance amending Section 1139.01 of the Zoning Code <br />in order to eliminate the locational and density requirements for pet stores and <br />animal hospitals in General Retail Business Districts. This legislation had been <br />reviewed on a couple of occasions. It changes the density requirements for pet <br />stores and animal hospitals in retail districts. Specifically, we used to have a <br />restriction that limited the location of such establishments to 700 feet from <br />residential use. We have some changes in North Olmsted that have come along. <br />The committee felt, with the help of the Planning Director, they could take a <br />better look at it and make good use of the legislation. It was reviewed and several <br />changes were made. One change was to remove the 700 foot limitation. Through <br />the committee process, animal training facilities and indoor boarding facilities <br />were made conditional uses, while leaving pet stores, animal hospitals, grooming <br />facilities as permitted uses in a retail district. There is no specific mention as to <br />outdoor boarding facilities as a permitted use in a retail district-a kennel, for <br />instance. Also, definitions were added to the code. The Planning Director <br />worked to put together a definition section of things like an animal hospital and <br />clinics, animal grooming facilities, animal training facilities, indoor animal <br />boarding facilities and kennels. Input was received from Mr. Tom Lee, an <br />attorney representing a pet store owner in North Olmsted who does have an <br />interest in these proceedings. He was happy to present the committee with <br />information, including one Council member who requested and received a DVD <br />presentation about the facility, an indoor animal boarding facility. At a previous <br />meeting, the committee heard from Mr. Jim Burns on the issue. The committee <br />recommended approval by a vote of 2-1, with Mr. Miller dissenting. <br />4 <br />
