Council Minutes of 12/2/2008 <br />11) The Civil Service Commission certified that Al Herman was the top scorer for the <br />position of Road Foreman, and he has accepted the position. <br />12) He would encourage Council not to suspend the rules for passage of Ordinances <br />2008-142 through 2008-146 and instead take an additional two weeks to consider the <br />legislation. He will be sending out a memo that details some of the ideas the <br />administration brought forwazd as the administration doesn't see a substantive basis for <br />what's occurring. They don't see an effort at good government. A resident commented <br />on this that it was the 5 P's: politics, personality, punitive, power struggles, posturing. <br />Regarding leaf removal, Councilman Orlowski commented that he had received <br />numerous calls from Ward IV residents who feel, as do Ward I residents, the early <br />October pick-up is before the leaves have fallen. The second round pick-up on certain <br />streets occurred four days early, so residents were unprepared and leaves have been on <br />the tree lawn for a long time. Residents are also concerned that a large snowfall before <br />the final pick-up will bury their leaves until spring. Other concerns are the number of <br />leaves which aze matted down on the streets and in the street gutters. He believes the <br />street sweeper truck is needed to clean the streets of the leaves to prevent the storm <br />sewers from becoming the depository and blocking the flow of storm water. He hopes <br />that can be addressed. Service Director Limpert came forward and commented that, as far <br />as some of the pick-ups being early, that's being done as an additional service and is not <br />part of the three passes. He has given the contractor the go-ahead to do that if he is ahead <br />of schedule, but those do not count as a required pass. There should not be leaves sitting <br />for weeks past due. He has received no real complaints this year, and it has been one o2' <br />the smoothest leaf pick-ups we have had. We always get some phone calls from people <br />who have trees that drop early wanting to know why the service hasn't begun. Then <br />there are others who call asking why the service started so early. This year's leaf pick-up <br />is going very well. If there are specifics, please share them with him and he will get it <br />taken care of. Mr. Orlowski asked Mr. Limpert to address the street sweeping in order to <br />get the leaves which are matted down at the curbs. Mr. Limpert said it would be best to <br />wait until the final round is off the streets. When we get some temperatures above <br />freezing, he will try to run the sweeper through the city. <br />Law Director Dubelko: 1) Regarding an issue that Councilman Orlowski had brought to <br />the Law Department about the care, control, and potential transfers of historical <br />documents, the department has completed research and provided advice to the Landmarks <br />Commission with copies to the Records Commission and Council. <br />2) Regarding the case of the city of North Olmsted v. Donald Patel. On November 19, a <br />Rocky River Municipal Court magistrate conducted a time to pay review and granted the <br />defendant additional time until January 14, 2009 in which to complete repairs or face a <br />$15,000 fine and potential time in jail. It's been reported to him that there's been good <br />progress in the repair work; hopefully, it gets done because we are trying to get the <br />maintenance done as opposed to collecting fines. <br />3) Prosecutions for month of November: Prosecutor Gordillo reports a total of 193 cases <br />handled-77 General Offenses and 116 Traffic; two trials and two convictions. <br />3 <br />
