Council Minutes of 8/19/2008 <br />4) On August 13, he attended a meeting of the Records Commission. The Commission <br />approved City Council's retention schedule. The Commission had a discussion regarding <br />the relationship between Records Commission and formulating retention schedules and <br />approving destruction of records and the Landmarks Commission's role as the archivist <br />for the city. They are working on that issue which came his way from Councilman <br />Orlowski as well as the Landmarks Commission itself. 1'he Commission is going to try <br />to more fully flesh out the relationship between Landmarks and Records Commission so <br />that Landmarks Commission can have a real role in determining what historical <br />documents should be archived and saved rather than destroyed in the usual process once <br />they've met their retention schedule deadline. <br />5) Regarding the RTA issue, some issues had come up at the last Council meeting as to <br />whether or not the city has legal avenues available to it on the basis of old litigation-the <br />transition agreement we entered into a couple of years ago and/or state statute ORC <br />Chapter 306. He has done some considerable work on those issues, some of which go <br />back about 28 years. As a law clerk for the city in 1978 and 1979, he recalls doing <br />research and helping Law Director Michael Gareau to put together that complaint and file <br />it in court. He has done a lot of work on this issue and will provide his results and <br />information to Council in writing because it would involve potential litigation and <br />strategies. It is better for those things to be done in writing or in executive session rather <br />than in open meetings. <br />6) Assistant Law Director O'Malley reports that there was apre-hearing conference in <br />the Eighth District Court of Appeals regarding the city's case with the IAFF Local 1267, <br />the appeal of the arbitration management rights arbitration awards. The case was not <br />settled and will go forward. The briefing deadline is August 29. <br />In the Finance Director's absence, the Clerk read her report: <br />"Council Report August 19, 2008. I attended the annual Tax Incentive Review Council <br />and Housing Council meetings on August 7, 2008. One CRA is completed this year. <br />Two of the larger ones will be over in collection year 2010. <br />On August 8, 2008 I participated in mediation with AFSCME Service unit to an <br />agreement, which the Mayor reported was ratified by the unit. This leaves Dispatch as <br />the final negotiations from the last bargaining cycle. <br />Chaired the Records Commission meeting on August 13, 2008 where Council, and Youth <br />Services Division and Division of Aging retention schedules were reviewed. Council's <br />was approved. We are holding the other two divisions pending further research by the <br />Law Department regarding client case files. <br />The Assistant Finance Director and I attended an annual update for governments and not <br />for profits at Youngstown State University which counted toward our required 40 hours <br />annually of continuing professional education. <br />I have amended the certificate of resources as we discussed in committee for the increase <br />in fuel reimbursement received from the school district by $60,000; Estate taxes <br />4 <br /> <br />
