Council Minutes of 6/17/2008 <br /> <br />• Ordinance 2008-62, sponsored by Councilman Orlowski, creating new Chapter <br />561 of the General Offenses Code entitled Criminal Activity Nuisances in order to <br />provide for the abatement of public nuisances and recovery of city response costs <br />incurred as a result of the multiple recurrence of such nuisance activities on <br />residential property located in the city of North Olmsted and declaring an <br />emergency. Pros and cons were discussed; the committee voted 3-0 in favor of <br />the ordinance with amendments. The amendments are as follows: Pace 4, <br />Section 561.01 (13) (b), the nuisance activities are changed from "three" to <br />"four" in the first line of the paragraph. Page 4, Section 561.02 (a), in the second <br />line of the paragraph, the nuisance activities are changed from "three" to "four"; <br />in the tenth line, the word "fourth" is changed to "fifth"; in the thirteenth line, the <br />word "third" is changed to "fourth." Page 4, Section 561.02 (b), in the first line <br />of the paragraph, the word "fourth" is changed to "fifth"; in the fourth line, the <br />word "third" is changed to "fourth." Councilman Kearney made a motion to <br />amend Ordinance 2048-62 as read. The motion was seconded by Councilman <br />Orlowski and passed unanimously. <br />• Liquor license for the Nee How Chinese Food Market at 23843 Lorain Road, a <br />new C1 and C2 liquor permit for take out only. The committee voted 3-0 to not <br />object. Councilman Kearney moved that Council not object to the new Cl and <br />C2 liquor permit for the Nee How Chinese Food Market, 23843 Lorain Road. <br />The motion was seconded by Councilman Mahoney. Roll call: Kearney, yes; <br />Mahoney, yes; Jones, yes; Barker, yes; Ryan, no; Orlowski, yes. The motion <br />passed with five yes votes and one no vote. <br />AUDIENCE PAR.TICIP;A.~IUN <br />1) Dennis Lambert, 25057 Carey Lane, said that Ordinance 2003-141 had defrocked the <br />Charter Review Commission. Their opinion is irrelevant and immaterial as Council can <br />do whatever they want. On another topic, he noted that Great Northern Blvd. is the <br />gateway to the city and the grass in that area is almost three feet tall. Cars coming off the <br />highway ramps cannot be seen because the grass is so high. (He distributed pictures of <br />the area to Council Members.) He wondered if recently passed legislation about property <br />maintenance was enforceable. <br />Mayor O'Grady commented that the property maintenance inspection program was a <br />very necessary innovation in our city. In a time of foreclosures and a time of housing <br />crisis, the city administration, with the support of the City Council, is taking the steps <br />necessary to protect our housing stock. He is proud of the addition of two property <br />maintenance inspectors and proud of the good work they're doing. <br />2) Terry Smith, 26615 Fairfax Lane, commended the city for sponsoring the Relay for <br />Life event. As a webmaster, he had used a link on the 5t. Richard's parish website to <br />advertise the event. It will be a good event for the city. With regard to Resolution <br />2008-89, he questioned why Council makes resolutions for national legislation. Is this <br />one of the techniques for sending ideas from a community to the national forum?
