It's particularly worthy to move in <br />the direction of an extension of a temporary conditional use permit when you have a <br />property owner who is willing to commit to spend so much money in an effort to resolve <br />a problem at his place of business. <br />2) Prosecutor Mike Gordillo's report for May: A total of 246 prosecutions; 117 General <br />Offenses cases; 129 Traffic; 0 trials in May; 141 pleas taken. <br />3) Civil litigation report: <br />• Fire fighter litigation regarding some management grievances, on May 27, 2008 <br />the Court of Appeals issued an order extending the jurisdiction of the trial court <br />on the remand issue until June 16, at which time the Court of Common Pleas is to <br />report to Court of Appeals conference attorney Ellen Ashwell regarding status of <br />the case. The pre-hearing conference set for June 3 was canceled and not yet <br />rescheduled. Outside counsel in this matter, Walter & Haverfield, filed a brief on <br />May 23 in opposition to the union's motion for sanctions. <br />• A grievance matter involving the fire fighters in an issue relating to comp time is <br />going to arbitration. Hearing is scheduled for June 10. On May 30, the city's <br />Law Dept. filed a motion to dismiss and bifurcate the hearing before arbitrator <br />Harry Graham. <br />• In Rocky River Municipal Court, city of North Olmsted v. Don Patel involved a <br />building code violations nuisance matter at the Knight's Inn on Lorain Road <br />involving a dilapidated metal staircase. The defendant was found guilty. The <br />matter has been set for sentencing on August 20 with the understanding that the <br />Building Code violation will be corrected prior to that date or the penalties will <br />reflect accordingly. <br />4) Asst. Law Director Carole Heyward reports there is a fair housing accessibility <br />training seminar set for June 11. She will be one of the speakers at the seminar which is <br />being held at the Visiting Nurse Association, 2500 East 22°d Street, Cleveland, Ohio. <br />The seminar is being hosted by bath the North Olmsted Fair Housing Review Board and <br />the Shaker Hts. Fair Housing Review Board along with the Housing Research and <br />Advocacy Center. The city of North Olmsted gets so much value from Asst. Law <br />Director Carole Heyward in her expertise in fair housing matters as well as her work in <br />real property maintenance. <br />Finance Director Copfer: 1) Attended a Records Commission meeting on May 21 where <br />the Mayor's department record retention schedule was approved. <br />2) The Finance Dept., Safety Dept., including the Fire Division, have had several <br />meetings to develop the fire false alarm billing as provided for in the code. Finance will <br />be receiving notice from the Fire Chief and will handle the billing and collections <br />utilizing MLTNIS's miscellaneous billing module. <br />3) The unaudited general purpose financial statements were transmitted to the Auditor of <br />State last week as required. The auditors were on-site today to complete their field work <br />over the next two weeks. <br />5 <br /> <br />
