Council Minutes of 4/15/2008 <br />being held for 23 minutes with no indication to the public that it was being delayed. It <br />has been reported out, so it's ready to proceed to second reading now. He recommended <br />against Council allowing it to proceed to second reading because of his concerns over a <br />potential open meeting law violation. His recommendation to Council is to refer it back <br />into committee because it has to be dealt with in some fashion rather than go forward to <br />the second reading. Councilman Ryan said, if the two members of his committee wanted <br />to return the legislation to committee, he would do so. Committee members Orlowski <br />and Gareau agreed the legislation should be taken back to committee. Councilman <br />Gareau moved that Resolutions 2008-46 and 2008-47 be removed from the agenda and <br />referred back to committee. The motion was seconded by Councilman Ryan and passed <br />unanimously. <br />Councilman Barker, chairperson of the Building, Zoning and Development Committee: <br />1) The Building, Zoning & Development Committee met Tuesday, April 8, 2008 at 7 <br />p.m. In attendance were committee members Barker, Gareau and Dailey Tones; Council <br />members Kearney, Mahoney, Orlowski and President Kennedy; Law Director Dubelko, <br />Planning Director Wenger and guests. Discussed were Ordinances 2008-18, 2008-36, <br />2008-37 and 2008-44; the development plans for BP Products North America who will <br />be renaming to "am pm" located at 29131 Lorain Road; T-Mobile cell tower installation <br />located at 29708 Lorain Road. The reports on the development plans will be made at the <br />May 6, 2008 Council meeting. <br />Ordinance 2008-18 is an ordinance providing for the amendment of the Zoning <br />Map of the City of North Olmsted by rezoning permanent parcel number 234-20- <br />049, located at 5764 Stearns Road, from its current zoning classification of One <br />Family Residence district use to General Retail Business district use. The <br />purpose of this rezoning is for BP to be able to redevelop the southwest corner of <br />Stearns and Lorain Roads. This rezoning is recommended by the Planning <br />Director and also has been before the Planning and Design Commission which <br />unanimously recommended approval on February 27, 2008. The BZD Committee <br />unanimously recommended approval to Council of Ordinance 2008-18 which <br />provides for the rezoning of Permanent Parce1234-20-049 located at 5764 Stearns <br />Road. <br />Ordinances 2008-36 and 2008-37 were discussed jointly as both pieces of <br />legislation need to pass for the project to move forward. Ordinance 2008-36 <br />provides for the amendment of the Zone Map of the City of North Olmsted by <br />rezoning the rear (north) portion of Permanent Parcel Number 233-11-012, <br />located at 29690 Lorain Road, known and used as Patton's Towing from B <br />Residence Single Family to General Retail Business. Ordinance 2008-37 <br />provides for the amendment of the Zone Map of the City of North Olmsted in <br />order to supplementally zone Fermanent Parcel Number 233-11-102 (012) so as <br />to include it within the Wireless Telecommunication Facilities Overlay District, <br />Chapter 1151, of the City of North Olmsted. The purpose of these two pieces of <br />legislation is for the placement of a cell tower on the property of Patton's Towing. <br />Ordinance 2008-36 accomplishes the rezoning of property that would probably <br />never have residential development, and it also cleans up some split zoning issues <br />6 <br />~.,..;~. <br />
