Special Council Minutes of 1/29/2008 <br />have people performing in a part-time capacity to give the equivalent of one full-time <br />employed individual. <br />Law Director Dubelko said he had initially prepared it in a more conservative fashion to <br />clearly identify there had to be so many individuals that would hold full-time positions <br />and so many that would hold part-time. He really hasn't had an opportunity to think <br />whether or not this is going to pose any problems whatsoever. The legislation is not an <br />emergency and does not go into effect for 30 days. He will look at it afterwards, and he <br />will get back to Council if he sees any problems. He will probably consult with Human <br />Resources to see whether or not that would pose any problems for them. This is being <br />done in an unorthodox way to lump the positions together and call them equivalents. <br />Councilman Gareau said he was unsure as to whether or not to proceed without the <br />direction and advice of counsel on that particular suggestion. Law Director Dubelko <br />said, if Council wants clear instruction today, he would say don't do it. His clear <br />instruction would be to identify the number of full-time positions that are being created <br />and separately identify the number of part-time positions being created. For example, <br />John Schneider, while he has done real property maintenance work, is filling a building <br />inspector position and he was formerly just doing 50% real property maintenance work. <br />With respect to creating an organizational chart, his advice would be to clearly identify <br />full-time positions and part-time positions so there's no questions later on what Council <br />meant by using the term "equivalent." <br />Councilman Gareau said he would withdraw the motion to amend Ordinance 2007-156 <br />and that it would be read as the original version. He would request the Director of Law <br />provide Council with an analysis of whether or not he believes the proposal conforms <br />with law. He noted that the committee had voted 3-0 to recommend approval of <br />Ordinance 2007-156 and to place it on second reading on this evening's agenda. <br />Continuing with the committee report, Councilman Gareau noted there were amendments <br />to Ordinance 2007-157. He made a motion to substitute Pietro A. DiFranco for Brian J. <br />Cave (for Assistant City Engineer} and to change the appointments of Daniel J. Collins as <br />City Engineer and Pietro A. DiFranco as Assistant City Engineer to a one-year term <br />instead of two years. The motion was seconded by Councilman Barker and passed <br />unanimously. Ordinance 2007-157 amended. <br />Councilman Gareau noted that the committee did unanimously recommend approval of <br />Ordinance 2007-157 on suspension of the rule as amended. The suspension was needed <br />because of the reorganization and the fact that the Bowen contract expires at the end of <br />the month. Councilman Barker made a friendly correction noting that the vote in the <br />committee was 2-1 as Mr. Kearney did not vote to recommend approval.
