Special Council Minutes of 1/29/2008 have people performing in a part-time capacity to give the equivalent of one full-time employed individual. Law Director Dubelko said he had initially prepared it in a more conservative fashion to clearly identify there had to be so many individuals that would hold full-time positions and so many that would hold part-time. He really hasn't had an opportunity to think whether or not this is going to pose any problems whatsoever. The legislation is not an emergency and does not go into effect for 30 days. He will look at it afterwards, and he will get back to Council if he sees any problems. He will probably consult with Human Resources to see whether or not that would pose any problems for them. This is being done in an unorthodox way to lump the positions together and call them equivalents. Councilman Gareau said he was unsure as to whether or not to proceed without the direction and advice of counsel on that particular suggestion. Law Director Dubelko said, if Council wants clear instruction today, he would say don't do it. His clear instruction would be to identify the number of full-time positions that are being created and separately identify the number of part-time positions being created. For example, John Schneider, while he has done real property maintenance work, is filling a building inspector position and he was formerly just doing 50% real property maintenance work. With respect to creating an organizational chart, his advice would be to clearly identify full-time positions and part-time positions so there's no questions later on what Council meant by using the term "equivalent." Councilman Gareau said he would withdraw the motion to amend Ordinance 2007-156 and that it would be read as the original version. He would request the Director of Law provide Council with an analysis of whether or not he believes the proposal conforms with law. He noted that the committee had voted 3-0 to recommend approval of Ordinance 2007-156 and to place it on second reading on this evening's agenda. Continuing with the committee report, Councilman Gareau noted there were amendments to Ordinance 2007-157. He made a motion to substitute Pietro A. DiFranco for Brian J. Cave (for Assistant City Engineer} and to change the appointments of Daniel J. Collins as City Engineer and Pietro A. DiFranco as Assistant City Engineer to a one-year term instead of two years. The motion was seconded by Councilman Barker and passed unanimously. Ordinance 2007-157 amended. Councilman Gareau noted that the committee did unanimously recommend approval of Ordinance 2007-157 on suspension of the rule as amended. The suspension was needed because of the reorganization and the fact that the Bowen contract expires at the end of the month. Councilman Barker made a friendly correction noting that the vote in the committee was 2-1 as Mr. Kearney did not vote to recommend approval. Mr. Gareau accepted the correction.
