Council Minutes of 2/3/2009 <br />• Ordinance 2009-11, an ordinance amending Section 137.01 Composition of <br />Chapter 137 of the Administrative Code entitled Department of Law in order to <br />eliminate certain duties of the Assistant Director of Law part-time and declaring <br />an emergency. Law Director Dubelko advised City Council that, consistent with <br />the request of the administration to achieve a balanced budget for the <br />appropriation ordinance, the Law Director and Law Dept. went through its <br />provided services and made a determination it would reduce the services being <br />provided by Asst. Director of Law Cazole Heyward. She was previously <br />prosecuting things such as the property maintenance cases, and she will now only <br />provide services to the Fair Housing Review Board. The Law Director did report <br />that those areas that Ms. Heyward used to work in would be covered by current <br />staff. This is not the best way to do it. Carole Heyward was doing an excellent <br />job in keeping our property maintenance department up and running and vigilant <br />in prosecutions to ensure residential and commercial compliance. In this tight <br />financial time, we are going to have to do things a different way. In that capacity, <br />we will miss her. But he understands the Law Director taking the initiative to try <br />to realize a savings to try to balance the budget. The committee, motion made by <br />Councilman Barker and seconded by Councilman Kearney, voted 3-0 to <br />recommend approval. <br />• Ordinance 2008-6, an ordinance amending Section 1501.1901 of the City <br />Taxation Code in order to temporarily reduce the City Income Tax Credit, and <br />declaring an emergency. This was a newer version of legislation that was brought <br />forward previously by the administration. The proposal was to reduce the tax <br />credit for residents from 100% to 50% in the yeaz 2010, and to 75% in the year <br />2011, and thereafter the credit would return to 100%. The committee, with <br />motion by Councilman Gazeau and second by Councilman Kearney, voted to hold <br />that matter in committee. A full report will be given when and if the legislation is <br />removed from committee. <br />2) A request was subsequently brought up by the Director of Law to suspend Ordinance <br />2009-11. That matter will be given consideration tonight in order to put the new <br />responsibilities in effect to have it ready for the appropriation ordinance. <br />Councilman Ryan, chairperson of the Intra-Governmental Relations Committee: 1) The <br />committee met last Tuesday to discuss Resolution 2009-4, a resolution creating a new <br />Citizens' Committee for the purpose of gathering and presenting to City Council projects <br />for consideration for the city's Community Development Block Grant (CDBG) <br />applications for fiscal years 2010 through 2012. All committee members were present. <br />Planning Director Wenger felt very strongly we needed to go forward with this. The <br />committee, motion by Councilman Ryan and second by Councilman Orlowski, voted 3-0 <br />to recommend approval. <br />Councilman Orlowski, chairperson of the Environmental Control Committee: 1) the <br />committee met at 7 p.m. on January 27, 2009. Present were committee members Barker, <br />Ryan, and Orlowski; Council Members Jones, Gazeau, Kearney, Mahoney, and Council <br />President Kennedy; the Mayor, Law Director, Service Director, Planning Director, Jared <br />Bartley of the Soil & Water Conservation District of Cuyahoga County, WWTP Supt. <br />4 <br />
