Council Minutes of 1/6/2009 <br />LEGISLATION <br />Ordinance No. 2008-117 introduced by Mayor O'Grady was given its third reading. An <br />ordinance providing for the amendment of the Zone Map of the city of North Olmsted by <br />rezoning Permanent Parcel Numbers 236-23-028, 236-23-017, 236-24-019, and 236-24- <br />020, located on Butternut Ridge Road east of Canterbury Road, from Single Residence A <br />to Residential Cluster District. Councilman Barker moved for adoption, and the motion <br />was seconded by Councilman Gareau. Roll call: Barker, no; Gareau, no; Kearney, yes; <br />Jones, no; Ryan, no; Orlowski, no; Mahoney, yes. The motion failed with five no votes <br />and two yes votes. Ordinance No. 2008-117 was not adopted. After the vote had been <br />announced, Councilman Kearney explained he had made a mistake and had meant to vote <br />no. He asked to change his vote but could not do so as the President had announced the <br />outcome of the vote. <br />Ordinance No. 2008-159 introduced by Mayor O'Grady was given its third reading. An <br />ordinance establishing the organization of the Fire Division of the Department of Public <br />Safety, and declaring an emergency. Councilman Gareau moved for adoption, and the <br />motion was seconded by Councilman Barker. Roll call: Gareau, no; Barker, no; <br />Mahoney, no; Orlowski, no; Jones, no; Ryan, no; Kearney, no. The motion failed <br />unanimously. Ordinance No. 2008-159 was not adopted. <br />Ordinance No. 2008-160 introduced by Mayor O'Grady was given its third reading. An <br />ordinance establishing the organization of the Police Division of the Department of <br />Public Safety, and declaring an emergency. Councilman Gareau moved for adoption, and <br />the motion was seconded by Councilman Barker. Roll call: Gareau, no; Barker, no; <br />Orlowski, no; Kearney, no; Mahoney, no; Ryan, no; Jones, no. The motion failed <br />unanimously. Ordinance No. 2408-160 was not adopted. <br />Ordinance No. 2008-156 introduced by Mayor O'Grady was given its second reading. <br />An ordinance amending Sections 949.01 (Removal of Diseased Trees), 949.03 (Cutting <br />and Trimming Required), and 949.99 (Penalty) of Chapter 949 of the North Olmsted <br />Streets, Utilities and Public Services Code in order to more efficiently provide for the <br />removal of dead, dying, diseased and/or fallen trees from private property, as amended. <br />Councilman Orlowski moved for suspension of the rule requiring three readings noting <br />the legislation had been heard in committee. The motion was seconded by Councilman <br />Barker and passed unanimously. Councilman Orlowski moved for adoption. The motion <br />was seconded by Councilman Barker and passed unanimously. Ordinance No. 2008-156 <br />adopted. <br />Ordinance No. 2008-164 introduced by Mayor O'Grady was given its second reading. <br />An ordinance amending Section 1501.1901 of the City Taxation Code in order to <br />temporarily reduce the tax credit for residents of the city who earn income in another <br />municipality from one hundred percent (100%) to fifty percent (50%), and declaring an <br />emergency. Councilman Gareau moved for suspension of the rule requiring three <br />readings noting it had been discussed in two or three committee meetings. The motion <br />was seconded by Councilman Barker and passed unanimously. Councilman Ryan <br />commented that the Mayor had brought forward a suggested modification to the <br />22 <br />
